Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for an Oriental Bay rental property, all Healthy Homes compliance work have to be finished within 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on an Oriental Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy contract, there could be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the information requested within 21 days from being informed of the request, they could receive an infringement notice and be fined as high as $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy contract is completed, and is updated throughout the tenancy as any relevant work gets completed.

It is also important to remember that a landlord who manage multiple rental properties could face additional fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have more than six properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Oriental Bay Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Oriental Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the air is clear from a crack or a gap or crack, then it’s probably a gap or hole that requirements sealing in some way. Large cracks and gaps should be stopped permanently. Cracks that are greater than 3mm and let air in or out into your home need to be sealed. In the case of an open fireplace isn’t used it can create draughts. This should be shut from. Heating Oriental Bay

Rental properties in Oriental Bay must have a fixed source of heat that is able to heat the living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs for it to be permanent (i.e. not portable) with at least 1.5 kW in heating capacity, and it must have the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to determine whether the existing fixed heater(s) are adequate or whether you will need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters, such as the portable LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you offer is an electric heater (or heat pump), it must include an thermostat. This will help make the heating more reliable and effective. For most properties, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments the smaller fixed electric heater may be sufficient.

If the living area already has a permanent heating source, such as a heat pump, then it might need some additional energy in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality because they’re not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Oriental Bay

Insulation Oriental Bay

The insulation of the ceiling and underfloor has been compulsory for all rent houses since July 1, 2019.
