Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on an Oriental Bay rental property, all Healthy Homes compliance tasks have to be done within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on an Oriental Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. The person who is liable for this fine is the person who is named on the lease agreement as being the person letting the property out which could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement requirements to be accurate before the tenancy agreement can be completed, and should be maintained throughout the duration of the tenancy when any related work is completed.

It’s also crucial to remember that landlords who have multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches. Landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Oriental Bay Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Oriental Bay and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside homes. A cold house is more expensive to heat, meaning wasting energy and incurring higher costs.

If a draught could be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught out of a hole or gap, then it is likely to be a gap or hole that requirements sealing in some way. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that let air in or out of your home require sealing. In the case of an open fireplace isn’t in use it can create draughts. This must be sealed off. Landlords and property managers are accountable for making sure that these draughts are stopped whenever possible.

Heating Oriental Bay

Rental properties in Oriental Bay should have a permanent source of heating that is able to heat the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs for it to be permanent (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum requirement for heat capacity for the main living room. If the heating that you provide is an electric heater (or heat pump), it should be equipped with an thermostat. This will make the heating more uniform and efficient. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments, a smaller fixed electric heater may suffice.

Insulation Oriental Bay

Ceiling and underfloor insulation is required on all rental houses from 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with the new standard. In some cases, current ceiling insulation, or the insulation of the subfloor space might need to be added or replaced.
