Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on an Oriental Bay rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on the Oriental Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the building they live in. If the the property manager doesn’t provide the necessary information within 21 days from receiving the request, they may receive an infringement notice and be fined upto $750.

In addition, there’s also a fine of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person responsible to pay this fine is the one who is identified on the tenancy agreement as being the person renting the property and it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance requirements to be correct before the tenancy agreement can be completed, and should be kept updated through the tenancy period as associated work has been completed.

It is also important to note that a landlord who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are reserved for severe breaches, and landlords with six or more properties can receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Oriental Bay Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required for all Oriental Bay and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with each Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

From July 1st 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Draughts can lead to dropping temperatures within households. A draughty home will cost more to heat, which means wasting money and energy.

Heating Oriental Bay

Rental properties in Oriental Bay need to have a stable heating source that can heat the living space to at least 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e. not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool may be used to determine if the current fixed heater(s) are adequate or whether you will require to "top-up" with an additional heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it must be equipped with a thermostat. This makes your heating more consistent and efficient. For most properties, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a fixed heating source such as heat pumps, it may require an update in order to comply with the standards. Some types of heaters can’t be used to meet the quality as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Oriental Bay

Every living space in a rental property has to have at least one opening window or exterior door to offer natural airflow. In addition, high moisture areas like kitchens and bathrooms need to have an externally vented extractor fan to remove moisture.

The ventilation standard is about recognising that dry air will be more easy to heat, and that a well ventilated rental property will be less prone to developing damp and mould.

Bedrooms, living rooms, dining rooms, and kitchens are considered liveable areas. Connecting spaces such as the hallway are not considered living spaces and therefore are not need an opening door or window.

Each door, window or the skylight needs at least to open up to the outside, but remain at an open angle to allow the circulation of fresh air and ventilation.

All kitchens and bathrooms, and any other room in your home that has shower, bath and cooktop or another water-generating appliance will require adequate extractor fans which are vented towards the outside. Insulation Oriental Bay

Ceiling and underfloor insulation is a requirement for all rent houses since 1 July 2019. Property managers and landlords are required to make sure the insulation meets standards that are in line with the latest quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space might require to be filled with or replaced.
