Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for an Oriental Bay rental property, all Healthy Homes compliance tasks must be finished by the end of 90 days.

Oriental Bay Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Oriental Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with all Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Oriental Bay

Oriental Bay rental properties need to have a stable source of heat that can warm the living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

However, in certain instances like small apartments the smaller fixed electric heater might be enough.

If your main living space already has a central heating source, such as a heat pump, then it may require a top up to be able to meet the standards. Certain types of heaters cannot be used to achieve the standard as they are either not effective, cost prohibitive to operate or are unsafe to operate.

Insulation Oriental Bay
