Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for an Oriental Bay rental property, all Healthy Homes compliance work have to be finished within 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on an Oriental Bay rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with one of the Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, there could be additional penalties or an infringement fee.

If the landlord or property manager does not supply the necessary information within 21 days from having received the inquiry, they may receive an infringement notification and be fined upto $750.

Oriental Bay Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Oriental Bay and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to the Healthy Homes Standards that apply or will apply to an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Heating Oriental Bay

Rental properties in Oriental Bay need to have a stable heating source which can warm the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year.
