Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Johnsonville rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Johnsonville rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the required information within 21 days of getting the notice, the tenant can be issued an infringement notice and be fined as high as $750.

In addition, there’s also a penalty of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is whoever is named on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is executed, and it must be updated through the tenancy period as relevant work gets completed.

It is important to keep in mind that landlords who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given only for serious breaches, and landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Clearly, failure to meet the Healthy Homes requirements can hit your bank account hard, and result in huge fines, in addition to still being required to adhere to the regulations. Unreasonable Gaps & Holes

Draught Stopping Johnsonville

Draughts may lead to lower temperatures in households. A cold home is more expensive to heat, meaning wasting energy and incurring higher costs.

If a draught can be noticed from gaps that are not adequate or holes the area needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a hole or gap, then it is most likely a gap or hole which requirements sealing in somehow. Cracks and gaps that are large should be permanently stopped. Gaps greater than 3mm that let air into or out within the house require to be sealed. For instance, if an open fireplace is not in use, it can create draughts. This must be sealed from. Landlords and property managers are accountable for ensuring that such draughts are squelched whenever possible.

You don’t need to block off gaps or holes which are part of the construction. For example, tiny gaps around doors and windows could be required to allow for movement of the structure as the house gets warmer and cooler, so that they are able to be shut and opened, rather than securing. We will check every window and door in the Healthy Homes assessment of your rental property.

Heating Johnsonville

Johnsonville rental properties should have a permanent source of heat that can warm the living area to at minimum 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to be fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required in the living area. A Heating Assessment Tool could be used to determine whether the fix heater(s) are sufficient or if you’ll require to "top-up" by adding a second heater. Open fires as well as unflued combustion heaters, such as portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it requirements to be equipped with a thermostat. This will make the heating more reliable and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like small apartments an electric, fixed heater may be sufficient.

If your living space already has a fixed heating source, such as heat pumps, it might just need a top up to meet the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Johnsonville

Each liveable space in the rental property should have at least one opening window or exterior door to offer natural ventilation. In addition, humid areas like kitchens and bathrooms must have a suitable venting fan outside to remove moisture.

A ventilation standard is all about understanding that the dry atmosphere is more easy to heat and that an apartment that is well-ventilated is less likely to develop damp and mould.

Bedrooms, living rooms, kitchens, and dining rooms are considered liveable spaces. Connecting spaces such as the hallway are not considered liveable and therefore don’t require an opening door or window.

Each window, door , or skylight needs for them to be in a position open to the outside, but remain closed to allow ventilation and fresh air ventilation.

All bathrooms and kitchens and every other room of your property with shower, bath cooker or any other moisture-producing item will require suitable extractor fans that can be vented to the outside. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in each livable space that includes extractor fans that are suitable for areas that are high in moisture.

Insulation Johnsonville

Insulation for underfloor and ceilings is mandatory to all rental houses as of July 1st, 2019. Property managers and landlords must ensure that the insulation is in line with this new standard. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be filled with or replaced.

A house that is well-insulated can reduce condensation, and decrease the risk of mould and dampness and it will make more easy for the household to retain heat.

Insulation requirements to be in compliance with the R-values for your area

The "R" is a symbol for thermal resistance and it is a measurement of how well insulation withstands heat flow. The more high the R-value, more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – all of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Johnsonville Moisture Ingress & Drainage

Keeping your rental property safe from water damage isn’t only about the inside of the building but you must make sure there is somewhere for rain, surface as well as groundwater to move, and also stop it from getting inside. When it is damp and moisture, it’s frequently those things that you aren’t aware of that could be a huge problem and end up causing damage to your investment and harming the tenant’s well-being.

Rental properties must be equipped with effective drainage to get rid of the stormwater and surface waters, and ground water, which includes an appropriate runoff or outfall. Making sure that the water has a proper place to go, and it doesn’t sit beneath structures is a crucial aspect of keeping your property dry.

In addition to the drainage system that will prevent water ingress, if the property has an enclosed space between the floor and the surface, a ground moisture barrier should be put in place if it’s reasonably practicable to do so.

A ground moisture barrier is usually a polythene sheet laid over the ground to prevent any moisture in the ground from entering the structure. It also helps prevent moisture damage to the underfloor insulation.
