Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Broadmeadows rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on the Broadmeadows rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the information requested within 21 days of having received the inquiry, they may receive an infringement notification and be fined as high as $750.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers that provide false or false Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as the person who is letting the property out and it could be the name of the landlord, or the property management company.

It’s important to keep in mind that a landlord with multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved for serious violations. Those who have six or more properties can be fined as high as $50,000, or as high as $100,000 in hearings.

Broadmeadows Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory throughout Broadmeadows and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applied throughout the tenancy period of the rental property.

Starting 1 July 2021

Heating Broadmeadows

Rental properties in Broadmeadows require a reliable heating source that can warm the largest or main living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

If the heating that you offer is an electric heater (or heat pump), it needs to have a thermostat. This makes the heating more uniform and efficient. For most houses, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If the living area already has a fixed heating source like heat pumps, it might require some additional energy to make sure it meets the requirements. Certain kinds of heaters aren’t able to be utilised to meet the standard since they’re either inefficient, unaffordable to operate and/or unsafe to run.
