Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Broadmeadows rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

As of 1st July 2021, when a new or renewed Tenancy is signed for the Broadmeadows rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the information requested within 21 days from being informed of the request, they can be issued an infringement notice and be fined upto $750.

Furthermore, there’s also a penalty of approximately $900 for landlords or property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is listed on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and must be updated during the entire tenancy, as necessary work related to it is finished.

It’s also crucial to note that landlords who manage multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved only for serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

In the end, a failure to comply with your Healthy Homes requirements can hit your wallet with significant fines and having to continue to comply. Do not risk your rental property call us now and make arrangements to have a house assessment performed for your rental property.

Healthy homes matter

What are the reasons why Healthy Homes Compliance So Important?

Around 1 in 3 households from New Zealand and Broadmeadows, and research indicates that rental homes are more likely to be colder, older and have less effective heating and tend to be of poorer quality than owner occupied properties.

Unreasonable Gaps & Holes

Draught Stopping Broadmeadows

Draughts may lead to less temperature in houses. A draughty house costs more to heat, resulting in wasted money and energy.

If a draught could be noticed from gaps that are not adequate or holes that it requirements to be closed.

What are unjustifiable gaps or holes?

If you can feel external air entering or a clear draught from a crack or a gap or crack, then it is likely to be a gap or hole that needs sealing in any way. Cracks and gaps that are large should be permanently stopped. The gaps that exceed 3mm that let air in or out of your home need the sealing. For example, if the open fireplace isn’t being used, it could cause draughts, and must be sealed off. Landlords and property managers are accountable for ensuring that such draughts are squelched as far as possible.

You don’t need to cover up gaps or holes in the construction. For example, tiny gaps around doors and windows could be required to allow movement of the building as the household is heated and cools so that they are able to be closed and opened instead of than sticking. We will inspect all windows and doors as part of our Healthy Homes assessment of your rental property.

Heating Broadmeadows

Rental properties in Broadmeadows must have a fixed source of heating that can heat the largest or main living space to a minimum of 18degC even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs for it to be permanent (i.e. not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to determine whether the existing installed heater(s) are sufficient or whether you will require to "top-up" with a new heater. Open fires as well as unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered to be acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it should include a thermostat. This will make your heating more consistent and effective. For most houses, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances like small apartments, a smaller fixed electric heater may suffice.

If the living area is already equipped with a fixed heating source like an air conditioner, it may require an update to make sure it meets the requirements. Some types of heaters can’t be utilised to meet the standard since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Broadmeadows

Each living space within the rental property should have at least one openable windows or an exterior door to provide natural airflow. Additionally, areas with high moisture spaces like kitchens and bathrooms must have a suitable venting fan outside to get rid of moisture.

It is the ventilation quality is all about understanding it is that the dry atmosphere is much easier to heat, and that a well ventilated rental property will be less prone to developing damp and mould.

Bedrooms, living spaces, kitchens, and dining areas are considered liveable spaces. Spaces that connect, such as the hallway aren’t considered liveable , and thus don’t need an opening door or window.

Each door, window or Skylight needs to have the ability open to the outside, but remain fixed in an open position, allowing the circulation of fresh air and ventilation.

The bathrooms in all kitchens and any other room in your home that has a bath, shower, cooktop or other high water-generating appliance will need suitable extractor fans that are vented to the outdoors. The Healthy Homes Assessment service will make sure there is sufficient ventilation in every living space, including suitable extractor fans in areas with high moisture.

Insulation Broadmeadows

The insulation of the ceiling and underfloor is a requirement to all rental houses from 1 July 2019. Property managers and landlords have to ensure the insulation meets current standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.

A properly insulated home can reduce condensation and lower the chance of dampness and mould, as well as making much easier to the household to hold the heat.

Insulation requirements to be in compliance with the R-values of your area.

The "R" is a symbol for thermal resistance and is a gauge of how well the insulation withstands heat flow. The higher the R-value, the higher the quality of insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 below floor R 1.3

Broadmeadows Moisture Ingress & Drainage

The security of your rental home from moisture isn’t just about what’s inside the building; you have to ensure there is somewhere for surface, rain and underground water to flow and prevent it from getting into the building. When it comes to moisture and damp it is frequently those things that you aren’t aware of that could be a huge problem, causing the property to suffer and harming the tenant’s well-being.

Rental properties require to be equipped with effective drainage to remove the stormwater and surface waters and ground water, which includes an appropriate outfall or runoff. Making sure the water has a place to go, and that it doesn’t sit beneath buildings is a vital aspect of keeping your property dry.

In addition to an irrigation system to stop water ingress, if the property has an enclosed space between your flooring and surface, a ground moisture barrier must be put in place when it is reasonably practicable to do so.

Ground moisture barriers are typically made of polythene and is laid on top of the ground to stop any moisture in the ground from accumulating into the home. It also assists in preventing from causing damage to the flooring insulation.
