Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Broadmeadows rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Broadmeadows rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement there may be additional penalties or an infringement fee.

If the the property manager doesn’t provide the required information within 21 days of being informed of the request, they will be issued an infringement notice and be fined as high as $750.

In addition, there is also a fine of up to $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is whoever is named on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is executed, and it must be updated throughout the tenancy as any related work is completed.

It is also crucial to be aware that a landlord who own multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved for severe breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Broadmeadows and New Zealand rental homes where it’s reasonably practicable to install.
