Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied contract is signed on a Wilton rental property, all Healthy Homes compliance work need to be done inside of 90 days.

As of 1st July 2021, when a new or renewed Tenancy is signed for a Wilton rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

All information in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It should be kept updated through the tenancy period as related work is completed.

It’s crucial to note that a landlord who own several rental properties can face greater penalties for non-compliance. The most severe penalties are given only for serious violations, and landlords who own more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required in all Wilton and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
