Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Wilton rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is completed, and should be maintained through the tenancy period as relevant work gets completed.

It’s also crucial to remember that a landlord who own several rental properties can face additional fines for non-compliance. The most severe penalties are given for severe violations. Those who have more than six properties could be penalised up to $50,000, and as much as $100,000 in hearings.

Wilton Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Wilton and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Wilton

Wilton rental properties should have a permanent source of heat that can warm the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater could be enough.

If the main living room is already equipped with a fixed heating source, like a heat pump, then it might need an upgrade to be able to meet the standards. Some types of heaters can’t be utilised to meet the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.
