Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on a Wilton rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as related work is completed.

It is also crucial to remember that landlords who manage multiple rental properties could face additional fines for non-compliance. The harshest penalties are given for serious violations. Those who have six or more properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory for all Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.
