Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance work need to be completed within 90 days.

The most severe penalties are given for severe violations, and landlords who own at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearings.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required to all Wilton and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Wilton rental properties require a reliable source of heat that can heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. The source of heat requirements that it be permanently fixed (i.e. not portable), at minimum 1.5 kW of heating capacity, and it must have the minimum capacity for heating required in the living area. If the heating system you provide is an electric heater or heat source, it must include the thermostat. This will make your heating more consistent and efficient. For most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In some instances, like small apartments the smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source like heat pumps, it may require a top up in order to comply with the standards. Some types of heaters can’t be used to achieve the quality since they’re either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Wilton

Insulation Wilton

Underfloor and ceiling insulation is a requirement on all rental homes since 1 July 2019. All landlords and property managers have to make sure the insulation meets current quality. In some instances, existing ceiling insulation or insulation in the sub floor space may need to be replaced or replaced.

A properly insulated home will reduce the risk of condensation and reduce the chances of dampness and mould, and it will make much easier to the house to hold heat.
