Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Wilton rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s also crucial to keep in mind that landlords with multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved for the most serious breaches, and landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Tenancies established from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Wilton and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

From July 1st 2021
