Rental Property Healthy Homes Fines
Fines for Failing to Comply
Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Wadestown rental property, all Healthy Homes compliance items must be finished within 90 days.
From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Wadestown rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to comply with each of Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.
Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to provide the necessary information within 21 days from being informed of the request, they could receive an infringement notification and be fined upto $750.
In addition, there is also a penalty of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is named on the tenancy agreement as being the person leasing the property out which could be the name of the landlord as well as the property management company.
The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It should be kept updated throughout the duration of the tenancy when any relevant work gets completed.
It’s also important to remember that landlords who own several rental properties can face more severe penalties for not complying. The harshest penalties are reserved for severe violations, and landlords who own six or more properties can be fined up to $50,000, or as high as $100,000 in hearing claims.
In the end, a failure to comply with compliance with Healthy Homes requirements can hit your pocket hard, and result in massive fines as well as continuing to be required to comply with the requirements. Do not risk your rental property, contact us today and make arrangements to have a house inspection performed on the rental property you are renting.
