Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Wadestown rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for the Wadestown rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement, there may be an additional penalty or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager does not provide the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined upto $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or other information. The person responsible to pay this fine is the one who is identified on the tenancy contract as the person leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed. It is updated through the tenancy period as relevant work gets completed.

It is also crucial to note that a landlord who own multiple rental properties may receive more severe penalties for not complying. The most severe penalties are handed down for severe violations. Those who have more than six properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

Healthy homes are important

What are the reasons why Healthy Homes Compliance important?

A majority of households rent the property in New Zealand and Wadestown, and research suggests that rental homes are most likely to be colder, older and have less efficient heating and tend to be lower quality than the homes of owners.

Moldy, damp and cold homes can have negative well-being outcomes, especially for illnesses such as colds and flu, asthma and cardiovascular conditions. In addition, people who report four or more major home quality issues often suffer from poor life satisfaction and lower well-being.

Improving the standard of Wadestown rental property will allow tenants to enjoy improved physical and mental health as well as lessen disruption to work, learning and living because of diseases. Your investment will be safeguarded from mildew, mould and damp damages, which means lower costs for maintenance in the long run.

The Healthy Homes Standards are a set of specific and minimal standards for heating, insulation, Ventilation, Moisture Ingress and Drainage, and Draught-stopping in Wadestown rental properties.

Unreasonable Gaps & Holes

Draught Stopping Wadestown

Draughts increase the likelihood of low temperatures inside houses. A humid home will cost more to heat, which results in wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes, it requirements to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or the air is clear from a hole or gap that is, it is probably a gap or hole that needs sealing in some way. Large cracks and gaps should be sealed permanently. Cracks that are greater than 3mm and let air in or out into the home need to be sealed. In the case of an open fireplace isn’t being used, it may cause draughts and should be blocked from. Property managers and landlords are responsible for making sure that such draughts are squelched whenever possible.

You don’t require to cover up holes or gaps that are part of the building. For example, tiny gaps around doors and windows might be necessary to allow for movement of the building when the household is heated and cools so that they are able to be closed and opened instead of than being stuck. We will inspect all doors and windows in our Healthy Homes assessment of your rental property.

Heating Wadestown

Wadestown rental properties must have a fixed heating source that is able to heat the largest or main living space to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements to be fixed (i.e., not portable) and at least 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. The Heating Assessment Tool can be used to determine if your current fix heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires as well as unflued combustion heaters such as small portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), then it must have a thermostat. This will help make the heating more consistent and efficient. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In certain situations, like small apartment buildings an electric, fixed heater could be enough.

If your living space already has a central heating source, like heat pumps, it might require a top up in order to comply with the standards. Some types of heaters can’t be used to meet the quality since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Wadestown

Each living space within the rental property should include at least one open doors or windows to offer natural ventilation. In addition, humid spaces like kitchens and bathrooms must have a suitable externally vented extractor to get rid of moisture.

A ventilation quality is all about understanding the fact that dry air will be much easier to heat and a well ventilated rental property will be less prone to developing mould and damp.

Bedrooms, living rooms kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces such as the hallway are not considered liveable and therefore do not require an opening door or window.

Each window, door or the skylight needs at least to open to the outside, but remain at an open angle in order to allow for fresh air circulation and air flow.

Bathrooms, kitchens, and any other area in your home with a bath, shower and cooktop or another moisture generating item will need proper extractor fan systems that are vented to the outside. The Healthy Homes Assessment service will verify that there is enough ventilation in every living space with the right extractor fan for areas that are high in moisture.

Insulation Wadestown

The insulation of the ceiling and underfloor is a requirement to all rental homes since July 1, 2019. All landlords and property managers have to ensure the insulation meets this new standard. In some cases, current ceiling insulation, or the insulation of the subfloor space might require to be topped up or replaced.

A well-insulated property will help to control condensation and lower the chance of dampness and mould, and it will make an easier task for the home to retain heat.

Insulation requirements to be in compliance with the R-values of your area.

The "R" stands for thermal resistance, and it is a measurement of how well the insulation resists heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the rest of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Wadestown Moisture Ingress & Drainage

Protecting your rental property from dampness isn’t just about the inside; you have to make sure there is somewhere to allow surface, rain or ground water, and prevent it from getting inside. When it concerns damp and moisture it is frequently what you don’t see that could be a huge problem, causing the property to suffer and affecting the tenant’s well-being.

Properties that are rented must be equipped with effective drainage for the removal of floodwaters, surface water and ground water. This includes an appropriate outfall or runoff. Making sure the water has a location to go, and that it doesn’t sit beneath structures is an important aspect of making sure your property is dry.

In addition to a drainage system to avoid the ingress of moisture, if your rental is enclosed between the floor and surface, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

Ground moisture barriers are usually made of polythene and is laid on top of the ground, in order to block any moisture that is present in the ground from entering the property. It also assists in preventing from causing damage to the flooring insulation.
