Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Wadestown rental property, all Healthy Homes compliance work must be done inside of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied lease is entered into on the Wadestown rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days of being informed of the request, they can receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the person who is listed on the tenancy contract as the person who is letting the property, so it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is executed, and it should be kept updated throughout the duration of the tenancy when any related work is completed.

It is important to keep in mind that landlords who have several rental properties can face greater penalties for non-compliance. The highest penalties are handed down for serious breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.

Wadestown Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required for all Wadestown and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records of their compliance with each Healthy Homes Standard that apply or will be in force during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any renewal, new or a change in lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.

What are unjustifiable gaps or holes?

Heating Wadestown

Wadestown rental properties require a reliable source of heat that can heat the largest or main living room to at least 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to be fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed for the main living space. For the majority of houses, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances like small apartment buildings, a smaller fixed electric heater may suffice.

If your living space already has a fixed heating source, such as heat pumps, it might need an update to meet the standards. Some types of heaters can’t be utilised to meet the quality as they are either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Wadestown

Every living space of a rental home must have at least one opening windows or an exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should have an externally vented extractor fan that can take moisture away.

Insulation Wadestown

Ceiling and underfloor insulation has been compulsory for all rent homes since July 1, 2019. All landlords and property managers should ensure that the insulation is in line with standards that are in line with the latest quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space may need to be added or replaced.

A well-insulated property will reduce the risk of condensation and lower the chance of mould and dampness and also makes more easy to allow the house to hold heat.
