Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Vogeltown rental property, all Healthy Homes compliance work must be completed within 90 days.

The harshest penalties are handed down for severe breaches, and landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Vogeltown Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Vogeltown and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records of their conformance with any Healthy Homes Standards that apply or will be applied during the tenancy of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

However, in some cases like small apartments, a smaller fixed electric heater might be enough.

If the main living room is already equipped with a fixed heating source, such as heat pumps, it might require an upgrade to be able to meet the standards. Some types of heaters can’t be used to comply with the standard as they are either expensive, inefficient and/or unhealthy to run.
