Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to make sure their Te Aro rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rentals must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Te Aro rental property, all Healthy Homes compliance work must be completed within 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on the Te Aro rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the required information within 21 days of receiving the request, they could receive an infringement letter and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and must be updated during the entire tenancy, as necessary work related to it is finished.

It’s crucial to note that a landlord with several rental properties can face greater penalties for non-compliance. The highest penalties are handed down for severe breaches. Landlords with at least six rental properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Te Aro Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is required in all Te Aro and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of an apartment rental.

Rental properties in Te Aro must have a fixed source of heat that can warm the largest or main living space to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements that it be permanently fixed (i.e., not portable), at minimum 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity in the living area. Property managers and landlords are required to make sure that the insulation is in line with current quality.
