Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Te Aro rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Te Aro rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. The person liable to pay this fine is the one who is named on the lease agreement as the person who is who is letting the property It could also be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy contract is signed, and ideally it should be kept updated during the entire tenancy, as related work is completed.

It is important to be aware that landlords who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Te Aro Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory in all Te Aro and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or altered tenancy contract.

Te Aro rental properties need to have a stable heating source that can heat the living room to at least 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

Insulation Te Aro

Insulation for underfloor and ceilings has been compulsory to all rental homes from 1 July 2019. All landlords and property managers should make sure that the insulation is up to this new standard. In some cases, current ceiling insulation, or the insulation of the sub floor space may require to be topped up or replaced.

A properly insulated home can reduce condensation and reduce the chances of mould and dampness and will also make more easy for the home to hold the heat.
