Fines for Failing to Comply

When Do I require to be in compliance with The Healthy Homes Standards?

Te Aro Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement in all Te Aro and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their the compliance with any Healthy Homes Standard that apply or will be applied during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Draughts are a major cause of less temperature in households. A cold house will cost more to heat, meaning wasting energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes the area needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a hole or gap and you are able to feel it, it’s likely a crack or hole which needs sealing in any way. Cracks and gaps that are large should be fixed permanently. Any gaps greater than 3mm that allow air in or out from the house require sealing. For instance, if an open fireplace isn’t used it may cause draughts and should be blocked from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed in the maximum extent imaginable.

Te Aro rental properties require a reliable source of heat that can warm the main or largest living space to at least 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e., not portable), at minimum 1.5 kW of heating capacity and have the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool could be used to determine if the existing installed heater(s) are adequate or if you’ll need to top up with a new heater. Open fires and unflued combustion heaters like portable LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it needs to be equipped with a thermostat. This makes your heating more consistent and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces, a smaller fixed electric heater might be enough.

If your living space is already equipped with a fixed heating source like an air conditioner, it may require an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard since they’re either costly, not affordable to run, or unsafe to operate.
