Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to ensure their Te Aro rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals are required to be fully in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Te Aro rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on a Te Aro rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not provide the required information within 21 days of having received the inquiry, they will receive an infringement notification and could be fined up to $750.

In addition, there’s also a fine of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is identified on the tenancy agreement as the one who is who is letting the property and it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also important to remember that a landlord who manage multiple rental properties could face more severe penalties for not complying. The highest penalties are reserved only for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

When do I need to meet The Healthy Homes Standards?

Te Aro Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement throughout Te Aro and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to each Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Te Aro

Draughts increase the likelihood of dropping temperatures within households. A humid house will cost more to heat, meaning wasting money and energy.

If a draught could be perceived as a result of gaps or holes the area needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air entering or the air is clear from a crack or a gap or crack, then it’s likely a crack or hole that requirements sealing in any way. Cracks or gaps with large gaps must be stopped permanently. Gaps greater than 3mm that let air into or out into your house require to be sealed. In the case of an open fireplace isn’t being used, it can create draughts. This should be sealed off. Property managers and landlords are accountable for ensuring that such draughts are squelched whenever possible.

There is no require to block off holes or gaps which are part of the building. For example, tiny gaps around windows and doors could be necessary to allow for movement of the building as the household heats and cools, so that they are able to be shut and opened, rather instead of being stuck. Heating Te Aro

Te Aro rental properties require a reliable source of heating that is able to heat the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs for it to be permanent (i.e., not portable), at minimum 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to determine whether your current fixed heater(s) are sufficient or if you’ll need to "top up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered to be safe heating options for the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump it must be equipped with the thermostat. This will help make the heating more uniform and effective. For most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source like the heat pump, it may need a top up to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Te Aro

Each living space within a rental house must have at least one openable window or exterior door to offer natural ventilation. In addition, high moisture areas such as kitchens and bathrooms should have an externally vented extractor fan to get rid of moisture.

Insulation Te Aro

Insulation for underfloor and ceilings is required on all rental houses since 1 July 2019. All landlords and property managers must make sure that the insulation meets standards that are in line with the latest standard. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be filled with or replaced.

A well-insulated house will help to control condensation and lower the chance of mould and dampness as well as making more easy to allow the house to retain heat.
