Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure that their Te Aro rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy, and all private rentals must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Te Aro rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

As of 1st July 2021, when a brand new, renewed or varied lease is entered into on the Te Aro rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement notice and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be accurate when the tenancy agreement is completed, and should be kept updated throughout the tenancy as any necessary work related to it is finished.

It is also crucial to keep in mind that a landlord who own several rental properties can face additional fines for non-compliance. The most severe penalties are handed down for severe violations. Those who have six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.

Te Aro Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required in all Te Aro and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standard that apply or will be applicable to their rental properties.

From 1 July 2021

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
