Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure that their Te Aro rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rentals must be completely compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Te Aro rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Te Aro rental property, all Healthy Homes compliance work must be completed inside of 90 days.

The person responsible for this fine is the one who is identified on the tenancy agreement as the person who is renting the property which could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy agreement is signed. It must be updated through the tenancy period as related work is completed.

It’s important to remember that a landlord with multiple rental properties may receive more severe penalties for not complying. The most severe penalties are handed down only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Te Aro Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Te Aro and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

What are unreasonable gaps and holes?

If you can feel external air entering or the air is clear from a hole or gap that is, it’s most likely a gap or an opening that needs sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air in or out within your house need the sealing. For example, if the open fireplace isn’t being used, it can cause draughts and must be sealed from. Property managers and landlords are responsible for ensuring that such draughts are squelched as far as possible.

You don’t require to block off gaps or holes which are part of the building. For instance, small gaps around doors and windows could be necessary to allow for movement of the building when the home gets warmer and cooler, so that they can still be closed and opened instead of than securing. Heating Te Aro

Te Aro rental properties should have a permanent source of heat that can warm the main or largest living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

Underfloor and ceiling insulation is a requirement for all rent houses from 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to standards that are in line with the latest quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space might need to be added or replaced.
