Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Te Aro rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on the Te Aro rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to provide the information requested within 21 days from receiving the request, they could receive an infringement letter and be fined upto $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers that provide false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is named on the lease agreement as being the person leasing the property out It could also be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct when the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any associated work has been completed.

It is also crucial to keep in mind that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down for serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.

Te Aro Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement to all Te Aro and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Te Aro

Te Aro rental properties must have a fixed heating source that can heat the largest or main living room to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to be fixed (i.e. not portable), at minimum 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living room. For most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. Ventilation Te Aro

Insulation Te Aro

The insulation of the ceiling and underfloor is a requirement to all rental houses since 1 July 2019. Property managers and landlords should make sure that the insulation meets current quality.
