Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Strathmore Park rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on a Strathmore Park rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

It’s also important to be aware that a landlord who own multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down for the most serious violations. Those who have six or more properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Strathmore Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with all Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of when the tenancy began.
