Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Roseneath rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for the Roseneath rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager is unable to supply the information requested within 21 days from receiving the request, they can receive an infringement letter and be fined up to $750.

In addition, there is also a penalty of up to $900 for landlords or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is named on the tenancy contract as the person leasing the property out and it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement needs to be correct before the tenancy agreement can be completed, and should be maintained through the tenancy period as associated work has been completed.

It’s crucial to remember that landlords who manage multiple rental properties could face even higher fines for non-compliance. The highest penalties are given for the most serious breaches. Landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Roseneath Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory throughout Roseneath and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Large gaps and cracks should be permanently stopped. Any gaps greater than 3mm that allow air to enter or exit from the house require seals. For instance, if an open fireplace isn’t used it may cause draughts and should be shut off. Landlords and property managers are responsible for making sure that these draughts are stopped in the maximum extent imaginable.

You don’t need to block gaps or holes in the construction. For instance, small gaps around windows and doors could be required to allow for the movement of the building when the household is heated and cools in order to let them be shut and opened, rather than sticking. Heating Roseneath

Roseneath rental properties must have a fixed heating source which can warm the living space to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs that it be permanently fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump it must be equipped with a thermostat. This will make the heating more consistent and efficient. In most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a central heating source, like the heat pump, it might just require a top up in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality because they’re expensive, inefficient or are unsafe to operate.

Ventilation Roseneath

Insulation Roseneath

Insulation for underfloor and ceilings is a requirement to all rental houses from 1 July 2019. All landlords and property managers are required to make sure that the insulation is in line with the new standard. In some instances, current ceiling insulation, or the insulation of the sub floor space may need to be topped up or replaced.

A properly insulated home will reduce the risk of condensation and lessen the likelihood of dampness and mould, and also makes it easier to allow the home to retain heat.
