Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Roseneath rental property, all Healthy Homes compliance items must be done inside of 90 days.

As of 1st July 2021, when a new or renewed lease is entered into on the Roseneath rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not supply the required information within 21 days of receiving the request, they can receive an infringement notice and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be correct at the time that the tenancy agreement is completed, and is updated throughout the tenancy as any relevant work gets completed.

It is also important to remember that landlords who have multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down for severe breaches, and landlords with at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

Tenancies signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Roseneath and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with the Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes
