Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Rongotai rental property, all Healthy Homes compliance tasks must be finished within 90 days.

If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s an additional fine of as much as $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the lease contract as the person leasing the property out and it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current before the tenancy agreement can be signed, and ideally it should be kept updated during the entire tenancy, as relevant work gets completed.

It is also crucial to be aware that a landlord who own several rental properties can face even higher fines for non-compliance. The harshest penalties are given for severe breaches, and landlords with at least six rental properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Rongotai Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Rongotai and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their conformance with each Healthy Homes Standard that apply or will be in force during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

A good heating system is important to ensure healthy houses

Heating Rongotai

Rongotai rental properties must have a fixed source of heating that is able to heat the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to be fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and meet the minimum capacity for heating required to heat the living space in general. Open fires and unflued combustion heaters such as portable LPG bottle heaters are not considered to be acceptable heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat pump, it requirements to be equipped with a thermostat. This will make the heating more reliable and efficient. For the majority of houses, bigger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments an electric, fixed heater could be enough.

If the living area already has a permanent heating source such as a heat pump, then it could require a top up to be able to meet the standards. Certain types of heaters cannot be used to meet the standard because they’re expensive, inefficient and/or unsafe to run.

Ventilation Rongotai
