Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Rongotai rental property, all Healthy Homes compliance work must be finished inside of 90 days.

It is crucial to note that a landlord who manage several rental properties can face additional fines for non-compliance. The highest penalties are handed down only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Rongotai and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that prove the compliance with the Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform to the Healthy Homes Standards within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rongotai rental properties must have a fixed source of heating which can warm the main or largest living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.
