Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Paparangi rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Paparangi rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the the property manager doesn’t supply the necessary information within 21 days of being informed of the request, they could receive an infringement notice and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers who offer a false or misleading Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is listed on the tenancy agreement as the person who is who is letting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct when the tenancy agreement is signed. It should be kept updated through the tenancy period as necessary work related to it is finished.

It is crucial to remember that a landlord who own multiple rental properties may face additional fines for non-compliance. The highest penalties are given for severe breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Paparangi Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory for all Paparangi and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate conformance with the Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply to the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.

From July 1st 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

For example, if the open fireplace isn’t used it may cause draughts and should be blocked from. For instance, small gaps around windows and doors may be required to allow for movement within the building as the home gets warmer and cooler, so that they can still be shut and opened, rather instead of being stuck. Heating Paparangi

Rental properties in Paparangi should have a permanent heating source that is able to heat the living area to at minimum 18degC, even on the winter coldest days. In certain situations, like small apartment buildings an electric, fixed heater might be enough.

If your living space is already equipped with a fixed heating source such as a heat pump, then it may require a top up to be able to meet the standards. Certain types of heaters cannot be used to achieve the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.
