Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Paparangi rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Furthermore, there’s also a fine of up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is listed on the tenancy agreement as the one who is who is letting the property It could also be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It should be maintained through the tenancy period as related work is completed.

It’s also important to be aware that landlords with multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for serious violations, and landlords who own more than six properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Paparangi Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory throughout Paparangi and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove the conformance to each Healthy Homes Standard that apply or will be in force to your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Paparangi

Draughts are a major cause of dropping temperatures within houses. A humid house costs more to heat, which completed jobs in wasting energy and increased bills.

If a draught can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air coming in or the sound of a clear draught emanating from a crack or a gap that is, it’s likely to be a gap or crack that requirements sealing in any way. Cracks and gaps that are large should be fixed permanently. Cracks that are greater than 3mm and allow air in or out from your house need seals. For instance, if an open fireplace isn’t in use it could cause draughts, and should be shut from. Property managers and landlords are responsible for making sure such draughts are eliminated as much as imaginable.

There is no need to cover up gaps or holes which are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for the movement of the building as the home is heated and cools so that they are able to be closed and opened rather than sticking. Heating Paparangi

Paparangi rental properties need to have a stable source of heat that is able to heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements for it to be permanent (i.e. not portable) that is, at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to determine if the existing installed heater(s) are adequate or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you offer is an electric heater or heat source, it should be equipped with a thermostat. This will make the heating more reliable and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like apartments with small spaces the smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source, like an air conditioner, it might just require some additional energy to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Paparangi

Insulation for underfloor and ceilings is mandatory on all rental houses since 1 July 2019. Property managers and landlords are required to make sure that the insulation meets the new quality. In some instances, an existing insulation on the ceiling or in the subfloor space may need to be filled with or replaced.

A properly insulated home will help to control condensation and lower the chance of mould and dampness and it will make an easier task to allow the home to keep the heat.

  • Zone 2 – the remainder of the North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 below floor R 1.3
