Fines for Failing to Comply
As of 1st July 2021, when a new, renewed or varied contract is signed on a Paparangi rental property, all Healthy Homes compliance items must be taken care of within 90 days.
Since the 1st July of 2021, if a new or renewed contract is signed on a Paparangi rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.
Failure to adhere to any of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement, it could result in an additional penalty or infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or the property manager doesn’t supply the information requested within 21 days of being informed of the request, they can receive an infringement notice and be fined up to $750.
In addition, there’s also a penalty of as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is identified on the tenancy agreement as the one who is letting the property out which could be the name of the landlord, or the company that manages the property.
All information in the Compliance Statement requirements to be current when the tenancy contract is signed. It should be maintained through the tenancy period as necessary work related to it’s finished.
It is also important to note that a landlord with multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down for the most serious violations, and landlords who own more than six properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.
