Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Ngauranga rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on the Ngauranga rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t provide the required information within 21 days from having received the inquiry, they could receive an infringement notification and be fined as high as $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be current when the tenancy contract is executed, and it must be updated throughout the tenancy as any necessary work related to it is finished.

It’s crucial to keep in mind that landlords who own multiple rental properties may face more severe penalties for not complying. The highest penalties are handed down for severe violations. Those who have six or more properties can be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Ngauranga Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Ngauranga and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with all Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Heating Ngauranga

Rental properties in Ngauranga should have a permanent source of heating that can warm the principal or the biggest living area to at minimum 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements for it to be permanent (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. Fires that are open and unflued heaters like mobile LPG bottle heaters are not considered to be safe heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it must be equipped with the thermostat. This makes the heating more consistent and efficient. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in some cases such as small apartments an electric, fixed heater might be enough.

If the living area already has a fixed heating source, such as an air conditioner, it could require an upgrade to meet the standards. Certain kinds of heaters aren’t able to be used to meet the quality because they’re not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Ngauranga

Ceiling and underfloor insulation has been compulsory on all rental houses since 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to this new standard.
