Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Ngauranga rental property, all Healthy Homes compliance work need to be done within 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t provide the information requested within 21 days from having received the inquiry, they can receive an infringement notification and be fined upto $750.

Furthermore, there’s also a fine of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is named on the lease agreement as the person who is who is letting the property, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it should be kept updated through the tenancy period as related work is completed.

It’s crucial to keep in mind that a landlord who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given only for serious violations, and landlords who own more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Ngauranga Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory throughout Ngauranga and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standards that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts are a major cause of low temperatures inside homes. A draughty home costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draft can be felt through gaps that are too large or holes the area needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air entering or a clear draught from a gap or hole that is, it’s probably a gap or an opening that needs sealing in the way you can. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that let air in or out of the house require sealing. For example, if the open fireplace isn’t in use it can cause draughts and should be blocked from. Landlords and property managers are responsible for ensuring such draughts are eliminated as far as possible.

You don’t need to block up intentional holes or gaps that are part of the building. For instance, small gaps around doors and windows may be required to allow for the movement of the structure when the home gets warmer and cooler, in order to let them be opened and closed rather than being stuck. Heating Ngauranga

Ngauranga rental properties require a reliable source of heat that can heat the main or largest living room to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine if the existing installed heater(s) are adequate or if you’ll require to top up with an additional heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters aren’t considered to be acceptable heating options in The Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), then it must have an thermostat. This will make the heating more reliable and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like small apartments, a smaller fixed electric heater might be enough.

If your main living space already has a central heating source like a heat pump, then it might just require an upgrade to meet the standards. Some types of heaters can’t be used to comply with the quality as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Ngauranga

The ventilation quality is all about acknowledging the fact that dry air will be easier to heat, and that a property that is well ventilated is less likely to be a victim of mould and damp.

Bedrooms, living spaces, dining rooms, and kitchens are considered liveable areas. Connecting spaces like the hallway are not considered liveable and therefore are not require an opening door or window.

Each door, window or skylight needs for them to be in a position of opening to the outside, and stay at an open angle to allow the circulation of fresh air and ventilation.

All bathrooms and kitchens as well as any other space in your home that has a bath, shower or cooktop, or any other moisture generating item will need suitable extractor fans that are vented to the outside. Insulation Ngauranga

Underfloor and ceiling insulation has been compulsory in all rental homes from 1 July 2019. Property managers and landlords have to make sure the insulation meets this new quality. In some instances, existing ceiling insulation or insulation in the subfloor space may require to be added or replaced.
