Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Ngauranga rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in an updated, renewed, or amended tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not provide the required information within 21 days from receiving the request, they will receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of up to $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is named on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is completed, and is updated during the entire tenancy, as associated work has been completed.

It is crucial to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for serious breaches. Landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

When Do I require to be in compliance with my Healthy Homes Standards?

Ngauranga Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Ngauranga and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with the Healthy Homes Standard that apply or will be applicable to your rental home.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts may lead to low temperatures inside homes. A damp home costs more to heat, which means wasting energy and resulting in higher bills.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming out of a hole or gap or crack, then it is likely a crack or crack that needs sealing in the way you can. Heating Ngauranga

Ngauranga rental properties require a reliable heating source that is able to heat the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine whether your current permanent heater(s) are sufficient or whether you will need to top up with a new heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters aren’t considered acceptable heating options for those following the Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), it must be equipped with the thermostat. This will help make the heating more uniform and efficient. For most properties, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In certain situations, like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source, such as heat pumps, it could require some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Ngauranga

Insulation Ngauranga

Underfloor and ceiling insulation is required in all rental homes since July 1, 2019. All landlords and property managers have to ensure that the insulation is in line with this new standard. In certain situations, the old ceiling insulation as well as insulation within the sub floor space may need to be topped up or replaced.
