Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to make sure that their Ngauranga rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rentals must be completely compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Ngauranga rental property, all Healthy Homes compliance work must be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on the Ngauranga rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager fails to provide the information requested within 21 days from receiving the request, they may receive an infringement notification and be fined upto $750.

In addition, there is also a penalty of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is identified on the tenancy agreement as the one who is leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement needs to be correct before the tenancy agreement can be executed, and it should be maintained throughout the tenancy as any necessary work related to it’s finished.

It’s also important to keep in mind that landlords who have multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given only for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Ngauranga Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Ngauranga and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with any Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts may lead to low temperatures inside houses. A draughty home is more expensive to heat, which completed jobs in wasting energy and incurring higher costs.

If a draught is noticed from gaps that are not adequate or holes, it requirements to be closed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see a clear draught out of a hole or gap that is, it’s likely a crack or hole which needs sealing in somehow. Large cracks and gaps should be stopped permanently. Gaps greater than 3mm that let air in or out of the home require to be sealed. For example, if the open fireplace isn’t being used, it may cause draughts and should be blocked from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed whenever imaginable.

There is no require to block up intentional gaps or holes which are part of the construction. Adequate heaters are crucial for well-being houses

Heating Ngauranga

Ngauranga rental properties should have a permanent source of heating that is able to heat the living space to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements for it to be permanent (i.e., not portable), at minimum 1.5 kW in heating capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool could be used to check if the installed heater(s) are sufficient or if you’ll require to top up with a new heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters are not considered acceptable heating options under the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump, it needs to be equipped with a thermostat. This will help make the heating more reliable and effective. For most homes, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like small apartment buildings, a smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source, like heat pumps, it may need a top up to be able to meet the standards. Certain kinds of heaters aren’t able to be used to meet the standard because they’re costly, not affordable to run, or unsafe to operate.

Ventilation Ngauranga

Each door, window or skylight needs to be able to open to the outside and remain closed, allowing ventilation and fresh air air flow.

All kitchens and bathrooms, and any other room in your home that has a bath, shower cooker or any other moisture generating item will require appropriate extractor fans that can be vented towards the outside. Insulation Ngauranga

Insulation for underfloor and ceilings is required for all rent homes since 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with this new quality. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be added or replaced.
