Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed contract is signed on the Ngauranga rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to provide the information requested within 21 days from getting the notice, the tenant may receive an infringement letter and be fined up to $750.

Additionally, there is also a fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is named on the lease agreement as the one who is letting the property out which could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be current before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as relevant work gets completed.

It’s crucial to remember that a landlord who have multiple rental properties could face additional fines for non-compliance. The harshest penalties are handed down for serious violations, and landlords who own six or more properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

When do I need to be in compliance with requirements of the Healthy Homes Standards?

Ngauranga Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Ngauranga and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will apply to the rental property.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts can lead to low temperatures inside houses. A draughty house will cost more to heat, resulting in wasted energy and increased bills.

If a draught can be felt through gaps that are too large or holes the area needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating from a hole or gap, then it is likely to be a gap or crack that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Gaps greater than 3mm that allow air to enter or exit within your home need the sealing. For instance, if an open fireplace is not in use, it can cause draughts and must be sealed off. Landlords and property managers are responsible for making sure that these draughts are stopped as far as imaginable.

You don’t require to cover up gaps or holes that are part of the construction. Heating Ngauranga

Rental properties in Ngauranga should have a permanent heating source that is able to heat the living room to at least 18degC even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to be fixed (i.e. not portable) with at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required in the living area. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it must have a thermostat. This will help make the heating more consistent and efficient. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartments an electric, fixed heater may suffice.

If your main living space already has a permanent heating source, such as a heat pump, then it might need an upgrade to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Ngauranga

Underfloor and ceiling insulation is required to all rental homes since July 1, 2019. All landlords and property managers have to make sure that the insulation meets this new standard.
