Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Newlands rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on the Newlands rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards within the deadlines can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager does not supply the necessary information within 21 days from being informed of the request, they could receive an infringement letter and be fined upto $750.

In addition, there is also a penalty of up to $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is named on the tenancy contract as the person renting the property, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is completed, and should be kept updated throughout the tenancy as any related work is completed.

It is important to note that a landlord who have multiple rental properties may face greater penalties for non-compliance. The most severe penalties are reserved only for serious violations. Those who have at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Newlands Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory for all Newlands and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Newlands

Newlands rental properties require a reliable heating source that can heat the principal or the biggest living room to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to check if your current fix heater(s) are sufficient or whether you will need to "top up" with a new heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options for those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it needs to be equipped with an thermostat. This makes the heating more reliable and efficient. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If the living area already has a fixed heating source, such as the heat pump, it could require an update to be able to meet the standards. Some types of heaters can’t be used to meet the quality since they’re either expensive, inefficient and/or unhealthy to run.
