Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords now have to make sure that their Newlands rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Newlands rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on a Newlands rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to provide the required information within 21 days of being informed of the request, they could receive an infringement notice and could be fined up to $750.

Additionally, there is an additional fine of approximately $900 for landlords or property managers who provide a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is letting the property out which could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement requirements to be correct before the tenancy agreement can be executed, and it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to note that a landlord who own multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for serious violations, and landlords who own more than six properties could be fined up to $50,000, or as high as $100,000 in hearings.

Newlands Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory to all Newlands and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with any Healthy Homes Standard that apply or will be applicable to the rental property.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Newlands

Draughts are a major cause of less temperature in houses. A humid house costs more to heat, which results in wasting money and energy.

If a draught could be perceived as a result of gaps or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a hole or gap, then it is likely to be a gap or crack that requirements sealing in any way. Cracks and gaps that are large should be fixed permanently. Gaps greater than 3mm that let air into or out from the house require the sealing. For instance, if an open fireplace is not in use, it could cause draughts, and must be sealed off. Property managers and landlords are responsible for making sure such draughts are eliminated as far as possible.

There is no need to block off gaps or holes which are part of the construction. For example, tiny gaps around doors and windows could be required to allow movement of the structure when the household gets warmer and cooler, so that they can still be opened and closed rather than securing. Heating Newlands

Rental properties in Newlands require a reliable source of heat that can heat the living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity to heat the living space in general. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. In some instances, like small apartments small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a central heating source, such as the heat pump, it might just need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Newlands

All landlords and property managers are required to ensure that the insulation is in line with current quality.
