Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Newlands rental property, all Healthy Homes compliance items have to be done inside of 90 days.

Newlands Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory to all Newlands and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with the Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.

Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside houses. A humid home will cost more to heat, meaning wasting energy and incurring higher costs.

What are unreasonable gaps and holes?

Heating Newlands

Newlands rental properties must have a fixed heating source that can warm the main or largest living space to a minimum of 18degC, even during the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to be fixed (i.e. not portable) and at least 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to determine whether the current fixed heater(s) are adequate or whether you will require to "top-up" with a new heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating that you offer is an electric heater (or heat pump), it requirements to include an thermostat. This will make the heating more consistent and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings, a smaller fixed electric heater could be enough.

If the main living room already has a fixed heating source like the heat pump, it could require a top up to meet the standards. Certain types of heaters cannot be utilised to meet the standard as they are either expensive, inefficient or unsafe to operate.

Ventilation Newlands
