Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Newlands rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on a Newlands rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the the property manager doesn’t supply the required information within 21 days from getting the notice, the tenant will receive an infringement notice and be fined upto $750.

Furthermore, there’s also a fine of approximately $900 for property owners or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is signed. It should be maintained throughout the tenancy as any necessary work related to it’s finished.

It’s also important to remember that a landlord who have multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved only for serious breaches. Landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in hearings.

Newlands Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory for all Newlands and New Zealand rental houses where it’s reasonably practicable to put in.
