Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Newlands rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

If the landlord or property manager does not supply the information requested within 21 days of being informed of the request, they can receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is signed. It is updated during the entire tenancy, as associated work has been completed.

It is also important to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The most severe penalties are reserved only for serious breaches. Landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Newlands Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Newlands and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

Unreasonable Gaps & Holes

Ceiling and underfloor insulation is mandatory on all rental houses from 1 July 2019. All landlords and property managers must make sure that the insulation is up to the new quality.
