Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Newlands rental property, all Healthy Homes compliance work must be taken care of within 90 days.

As of 1st July 2021, once a new, renewed or varied Tenancy is signed for a Newlands rental property, all Healthy Homes compliance work must be finished within 90 days.

If the property manager fails to supply the information requested within 21 days from having received the inquiry, they may be issued an infringement notice and be fined as high as $750.

In addition, there’s also a fine of as much as $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out which could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It is also important to note that a landlord who have several rental properties can face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in hearings.

Newlands Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory in all Newlands and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will apply to your rental home.

Starting 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

Heating Newlands

Newlands rental properties require a reliable source of heating which can warm the{ main or largest|| largest or main| principal or the biggest} living space to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to remain fixed (i.e. not portable) that is, at least 1.5 horsepower in capacity, and meet the minimum heating capacity needed for the main living room. For most homes, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. In certain situations, like small apartments the smaller fixed electric heater could be enough.

If the main living room already has a central heating source, like an air conditioner, it might require a top up to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either costly, not affordable to run, or are unsafe to operate.

Ventilation Newlands
