Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.
Since the 1st July of 2021, if a new, renewed or varied lease is entered into on a Mount Victoria rental property, all Healthy Homes compliance work must be completed within 90 days.
Inability to adhere to each of Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement, there could be an additional fine or infringement fee.
Any tenant can ask for details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager fails to supply the information requested within 21 days of getting the notice, the tenant could receive an infringement notice and could be fined up to $750.

It is also important to remember that landlords who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved for the most serious violations. Those who have six or more properties can be fined as high as $50,000, and as much as $100,000 in hearings.
