Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required in all Mount Victoria and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their conformance with the Healthy Homes Standard that apply or will be in force during the tenure of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
