Healthy Homes Assessment Services

Did you have any idea that the Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to ensure their Maupuia rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rental properties are required to be fully conforming by the 1st July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Maupuia rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for a Maupuia rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to supply the necessary information within 21 days of getting the notice, the tenant will receive an infringement notice and be fined as high as $750.

In addition, there is also a penalty as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is named on the lease agreement as the person who is who is letting the property which could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be current at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is also important to note that a landlord who manage several rental properties can face additional fines for non-compliance. The highest penalties are given only for serious breaches, and landlords with six or more properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Maupuia Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all Maupuia and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of less temperature in households. A cold house is more expensive to heat, which means wasting energy and incurring higher costs.

What are unreasonable gaps or holes?

If you can feel external air coming in or the air is clear out of a hole or gap or crack, then it is likely to be a gap or hole that requirements sealing in somehow. Cracks and gaps that are large should be permanently stopped. Any gaps greater than 3mm that let air in or out of the home require the sealing. For example, if the open fireplace is not in use, it can cause draughts and should be shut from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed whenever possible.

You don’t require to cover up holes or gaps in the building. For example, tiny gaps around windows and doors may be required to allow for movement within the building as the house heats and cools, so that they can still be closed and opened instead of instead of being stuck. Proper heating is important for healthy homes

Heating Maupuia

Maupuia rental properties must have a fixed source of heating that can warm the main or largest living room to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs to be fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to check if your current fixed heater(s) are sufficient or whether you will need to top up by adding a second heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options in Healthy Homes Standard. Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it should be equipped with an thermostat. This will make the heating more consistent and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases like small apartments small apartments, a smaller electric fixed heater might be enough.

If the main living room already has a fixed heating source, like the heat pump, it might just need an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Maupuia

Insulation for underfloor and ceilings has been compulsory to all rental houses from 1 July 2019. Property managers and landlords should ensure the insulation meets current quality. In some cases, old ceiling insulation as well as insulation within the sub floor space might need to be filled with or replaced.
