Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to make sure their Maupuia rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed for a Maupuia rental property, all Healthy Homes compliance work have to be done within 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to supply the required information within 21 days from receiving the request, they may receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for property owners or property managers who offer a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is named on the tenancy contract as the person renting the property, so it could be the name of the landlord as well as the company that manages the property.

When do I need to be in compliance with The Healthy Homes Standards?

Maupuia Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Maupuia and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with each Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of less temperature in households. A draughty home is more expensive to heat, which means wasting money and energy.

Heating Maupuia

Maupuia rental properties need to have a stable source of heat which can warm the living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable), at least 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or whether you will need to ‘top up’ with an additional heater. Open fires as well as unflued combustion heaters like mobile LPG bottle heaters are not considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it needs to have the thermostat. This makes the heating more uniform and efficient.
