Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords must make sure that their Maupuia rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals must be fully conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Maupuia rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Since the 1st July of 2021, once a new or renewed contract is signed on the Maupuia rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the required information within 21 days from getting the notice, the tenant could receive an infringement notice and could be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords and property managers that provide false or misleading Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is named on the lease contract as the person leasing the property out, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement needs to be up-to-date before the tenancy agreement can be signed, and ideally it is updated during the entire tenancy, as related work is completed.

It is also crucial to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for serious violations. Those who have at least six rental properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Maupuia Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory for all Maupuia and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be applied throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within homes. A humid home costs more to heat, which means wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes or holes, it needs to be closed.

Heating Maupuia

Maupuia rental properties should have a permanent source of heat that is able to heat the largest or main living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to be fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool may be used to check if the current installed heater(s) are sufficient or whether you will need to "top up" with a new heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), it needs to include an thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases such as small apartments the smaller fixed electric heater might be enough.

If your living space already has a permanent heating source, like the heat pump, it might just require a top up to be able to meet the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either not effective, cost prohibitive to operate and/or unsafe to run.

Insulation Maupuia

Ceiling and underfloor insulation is mandatory to all rental homes since 1 July 2019. All landlords and property managers must ensure the insulation meets this new quality. In some instances, old ceiling insulation as well as insulation within the sub floor space may require to be replaced or replaced.
