Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Maupuia rental property, all Healthy Homes compliance items must be done within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Maupuia rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not supply the necessary information within 21 days from being informed of the request, they can receive an infringement notice and be fined up to $750.

In addition, there is also a penalty up to $900 for property owners or property managers who have provided a false or false Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is named on the tenancy contract as the person renting the property, so it could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be correct when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to be aware that landlords who manage several rental properties can face more severe penalties for not complying. The highest penalties are handed down for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Maupuia Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory to all Maupuia and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their the conformance to each Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Maupuia

Rental properties in Maupuia should have a permanent source of heating that can warm the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs that it be permanently fixed (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool may be used to check if the current fixed heater(s) are adequate or if you’ll require to "top up" with an additional heater. Open fires and unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump it should include the thermostat. This will help make the heating more uniform and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments, a smaller fixed electric heater may suffice.

If the main living room already has a fixed heating source like heat pumps, it could require an upgrade to be able to meet the standards. Some types of heaters can’t be used to meet the quality since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Maupuia

The insulation of the ceiling and underfloor is mandatory in all rental homes as of July 1st, 2019. Property managers and landlords are required to make sure the insulation meets current standard.
