Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Lyall Bay rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Lyall Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they could be issued an infringement notice and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person who is letting the property which could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to note that a landlord who have several rental properties can face more severe penalties for not complying. The most severe penalties are handed down only for serious breaches, and landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

It is clear that failure to comply with your Healthy Homes requirements can hit your bank account hard, with large fines in addition to still being required to adhere to the regulations. Don’t risk your rental property call us now and make arrangements to have a home assessment performed on the rental property you are renting.

Unreasonable Gaps & Holes

Draught Stopping Lyall Bay

Draughts increase the likelihood of less temperature in houses. A damp home costs more to heat, which means wasting money and energy.

If a draught can be felt from unreasonable gaps or holes or holes, it requirements to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see a clear draught out of a hole or gap and you are able to feel it, it is likely to be a gap or hole which needs sealing in any way. Cracks or gaps with large gaps must be sealed permanently. Any gaps greater than 3mm that let air in or out of the house require the sealing. For example, if an open fireplace isn’t in use it can cause draughts and should be blocked from. Landlords and property managers are accountable for ensuring that such draughts are squelched as far as possible.

There is no need to block holes or gaps which are part of the construction. For example, tiny gaps around doors and windows may be required to allow for the movement of the building when the household heats and cools, to allow them to be closed and opened rather than securing. We will inspect all doors and windows in your Healthy Homes assessment of your rental property.

Adequate heaters are important for well-being homes

Heating Lyall Bay

Lyall Bay rental properties require a reliable source of heating that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements to remain fixed (i.e. not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to determine whether the permanent heater(s) are adequate or if you’ll require to ‘top up’ with a new heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters aren’t considered to be acceptable heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), it should include a thermostat. This makes your heating more consistent and effective. For most homes, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in some cases like small apartments the smaller fixed electric heater may suffice.

If the main living room already has a fixed heating source, like heat pumps, it may require some additional energy in order to comply with the standards. Some types of heaters can’t be used to achieve the quality since they’re either expensive, inefficient or are unsafe to operate.

Ventilation Lyall Bay

Every living space of a rental property must have at least one opening window or exterior door to provide natural airflow. Furthermore, moist spaces like kitchens and bathrooms should be equipped with an externally vented extractor to eliminate moisture.

It is the ventilation quality is all about recognising the fact that dried air can be more easy to heat and an apartment that is well-ventilated will be less prone to developing mould and damp.

Living rooms, bedrooms, dining rooms, and kitchens are all considered living spaces. Connecting spaces such as the hallways are not liveable and therefore don’t need an opening door or window.

Each window, door or the skylight requirements at least to open to the outside while remaining fixed in an open position in order to allow the circulation of fresh air and air flow.

The bathrooms in all kitchens and every other room of your home with shower, bath, cooktop or other high humidity-generating items will need appropriate extractor fans that can be vented to the outdoors. The Healthy Homes Assessment service will make sure there is sufficient ventilation in each livable space and will also check for the proper extractor fans in areas with high moisture.

Insulation Lyall Bay

Underfloor and ceiling insulation is required to all rental homes from 1 July 2019. All landlords and property managers are required to ensure that the insulation is in line with the new standard. In some instances, old ceiling insulation as well as insulation within the sub floor space might require to be replaced or replaced.

A house that is well-insulated can reduce condensation, and decrease the risk of mould and damp, and also makes an easier task for the household to hold the heat.

Insulation needs to be in compliance with the R-values required for your area

The "R" refers to thermal resistance, and is a measure of how well insulation withstands heat flow. The higher the R-value, the more effective the insulation.

Lyall Bay Moisture Ingress & Drainage

The security of your rental home from dampness isn’t just about what’s inside the building It’s about having to make sure there is somewhere for surface, rain as well as groundwater to move, and to prevent it from getting into the building. When it is about damp and water, it’s frequently those concerns that you aren’t aware of that can cause a lot of trouble and cause damage to your investment and harming your tenant’s health.

Rental properties must be equipped with efficient drainage to get rid of the stormwater and surface waters and ground water, including an appropriate outfall or runoff. Making sure that water has a place to go and that it doesn’t get sucked into structures is an important aspect of maintaining your property’s dry.

Alongside the drainage system that will prevent moisture ingress, if your property has an enclosed space between your floor and the surface, a ground moisture barrier should be put in place if it is reasonably practicable to do so.

An underground moisture barrier usually a sheet of polythene that is placed over the ground, in order to block any moisture that is present in the ground from entering the building. It also assists in preventing water damage to the floor insulation.
