Fines for Failing to Comply
Beginning on July 1st, 2021, when a new or renewed contract is signed on a Lyall Bay rental property, all Healthy Homes compliance tasks must be done inside of 90 days.
Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Lyall Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to meet any of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they could be issued an infringement notice and be fined up to $750.
Furthermore, there’s also a fine of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person who is letting the property which could be the name of the landlord as well as the property management company.
The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.
It’s also crucial to note that a landlord who have several rental properties can face more severe penalties for not complying. The most severe penalties are handed down only for serious breaches, and landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.
