Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Lyall Bay rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

It’s also important to keep in mind that a landlord who manage multiple rental properties may receive greater penalties for non-compliance. The highest penalties are handed down only for serious breaches. Landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Lyall Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Lyall Bay and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with each Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy began.
