Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Lyall Bay rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Lyall Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to provide the required information within 21 days of receiving the request, they may receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed. It must be updated during the entire tenancy, as necessary work related to it’s finished.

It’s also important to note that a landlord with several rental properties can face even higher fines for non-compliance. The highest penalties are handed down for severe breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

When Do I need to meet the Healthy Homes Standards?

Lyall Bay Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Lyall Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with each Healthy Homes Standard that apply or will be applied to an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.

What are unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught out of a hole or gap or crack, then it’s likely to be a gap or an opening that needs sealing in any way. Large gaps and cracks should be stopped permanently. Any gaps greater than 3mm that allow air to enter or exit from the house need to be sealed. For instance, if an open fireplace is not in use, it can create draughts. This should be shut from. Property managers and landlords are responsible for ensuring such draughts are eliminated as far as possible.

You don’t require to block up intentional holes or gaps that are part of the construction. Heating Lyall Bay

Rental properties in Lyall Bay need to have a stable source of heat which can warm the living space to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e., not portable), at least 1.5 horsepower in capacity, and meet the minimum capacity for heating required in the living area. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances like small apartment buildings the smaller fixed electric heater may suffice.

If your living space already has a fixed heating source like a heat pump, then it might require an upgrade to meet the standards. Some types of heaters can’t be utilised to meet the standard since they’re either expensive, inefficient and/or unhealthy to run.

Property managers and landlords are required to ensure that the insulation is in line with current quality.
