Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on the Linden rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement, there may be an additional penalty or infringement fee.

The person who is responsible for this fine is the one who is listed on the tenancy contract as the person who is letting the property which could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance requirements to be current when the tenancy contract is executed, and it is updated throughout the tenancy as any associated work has been completed.

It is also crucial to be aware that landlords who own multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved for the most serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Linden and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with any Healthy Homes Standards that apply or will be applied during the tenure of their rental properties.

From 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts may lead to less temperature in houses. A damp home will cost more to heat, meaning wasting energy and resulting in higher bills.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see an unobstructed draught coming out of a hole or gap, then it’s probably a gap or hole which needs sealing in some way. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and let air into or out into your home require the sealing. For example, if the open fireplace isn’t used it could cause draughts, and should be sealed off. Property managers and landlords are responsible for making sure such draughts are eliminated whenever possible.

You don’t require to block up intentional gaps or holes which are part of the building. For instance, small gaps around doors and windows could be necessary to allow for movement of the structure when the house heats and cools, so that they are able to be closed and opened instead of than sticking. Heating Linden

Linden rental properties must have a fixed source of heat that can warm the living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool may be used to determine whether the fix heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters are not considered acceptable heating options for those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump it must have a thermostat. This makes the heating more uniform and efficient. In most houses, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like small apartment buildings, a smaller fixed electric heater could be enough.

If your main living space already has a fixed heating source, like an air conditioner, it might need some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Linden
