Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance work must be completed within 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Linden rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not supply the necessary information within 21 days of being informed of the request, they could receive an infringement letter and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is identified on the tenancy agreement as the one who is renting the property, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be current before the tenancy agreement can be executed, and it should be maintained throughout the tenancy as any relevant work gets completed.

It’s also important to be aware that a landlord who own multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory to all Linden and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable to your rental home.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts increase the likelihood of lower temperatures in homes. A cold house will cost more to heat, which results in wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the air is clear from a crack or a gap and you can feel it, it’s likely a crack or crack that needs sealing in somehow. Large cracks and gaps should be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit within the house need seals. For example, if the open fireplace isn’t in use it could cause draughts, and should be sealed off. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed as far as possible.

There is no require to block up intentional gaps or holes that are part of the construction. For example, tiny gaps around doors and windows could be required to allow for movement of the building when the household is heated and cools so that they are able to be shut and opened, rather than being stuck. Heating Linden

Rental properties in Linden must have a fixed source of heat that is able to heat the largest or main living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to remain fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum required heating capacity for the main living space. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, then it must include the thermostat. This makes the heating more reliable and effective. In most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, like apartments with small spaces an electric, fixed heater might be enough.

If your living space is already equipped with a fixed heating source, such as a heat pump, then it may need an upgrade to meet the standards. Certain types of heaters cannot be used to meet the standard because they’re expensive, inefficient or are unsafe to operate.

Ventilation Linden

Every living space in a rental property must include at least one open window or exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to take moisture away.

The ventilation standard is all about understanding the fact that the dry atmosphere is easier to heat, and that a property that is well ventilated is less likely to be a victim of mould and damp.

Bedrooms, living rooms, kitchens, and dining areas are considered liveable areas. Connecting spaces such as the hallway aren’t liveable and don’t need an opening window or door.

Insulation Linden

Underfloor and ceiling insulation is mandatory for all rent houses since 1 July 2019. Property managers and landlords should ensure that the insulation is up to current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space might need to be filled with or replaced.
