Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to provide the required information within 21 days of having received the inquiry, they could receive an infringement letter and be fined as high as $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the one who is who is letting the property which could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct before the tenancy agreement can be executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It is crucial to note that landlords who own multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for serious violations. Those who have six or more properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all Linden and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with all Healthy Homes Standards that apply or will apply during the tenancy of an apartment rental.

From July 1st 2021

  • Private landlords and property managers should make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Linden

Linden rental properties need to have a stable source of heat that can heat the living space to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e. not portable) and at least 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity to heat the living space in general. Ventilation Linden
