Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Linden rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

From the 1st of July in 2021, once a new or renewed contract is signed on the Linden rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The information contained in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained throughout the tenancy as any necessary work related to it is finished.

It is also crucial to keep in mind that landlords who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved for serious breaches. Landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Linden Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required in all Linden and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of dropping temperatures within homes. A draughty home is more expensive to heat, meaning wasting energy and resulting in higher bills.

Heating Linden
