Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Kilbirnie rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.
As of 1st July 2021, when a new or renewed lease is entered into on the Kilbirnie rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.
Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager does not supply the necessary information within 21 days from having received the inquiry, they will receive an infringement notice and could be fined up to $750.
In addition, there’s an additional fine of up to $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is named on the lease contract as the person who is letting the property It could also be the name of the landlord or the company that manages the property.
The information contained in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be kept updated throughout the tenancy as any associated work has been completed.
It’s also important to note that a landlord who have several rental properties can face more severe penalties for not complying. The most severe penalties are handed down for severe breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.
