Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Kilbirnie rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is whoever is named on the lease contract as the person renting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is executed, and it must be updated throughout the tenancy as any related work is completed.

It’s important to note that a landlord who manage several rental properties can face greater penalties for non-compliance. The highest penalties are reserved for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement to all Kilbirnie and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standard that apply or will be applied during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
