Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Kilbirnie rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.

Kilbirnie Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Kilbirnie and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
