Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Khandallah rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

The information contained in the Compliance Statement requirements to be accurate at the time that the tenancy agreement is executed, and it must be updated through the tenancy period as related work is completed.

It’s crucial to remember that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory for all Khandallah and New Zealand rental homes where it’s reasonably practicable to put in.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
