Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Khandallah rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

It is crucial to remember that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are reserved for the most serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required throughout Khandallah and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
