Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Khandallah rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

Since the 1st July of 2021, once a new or renewed contract is signed on the Khandallah rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement, there may be an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to supply the information requested within 21 days from having received the inquiry, they will receive an infringement notification and be fined as high as $750.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or information. The person liable to pay this fine is the one who is listed on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it must be updated through the tenancy period as related work is completed.

It’s also important to be aware that landlords who own several rental properties can face greater penalties for non-compliance. The highest penalties are given only for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

If you fail to meet your Healthy Homes requirements can hit your pocket and result in significant fines and having to continue to comply. Don’t risk your rental property Contact us now and ask us to conduct a home evaluation performed on your rental property.

Healthy homes matter

What are the reasons why Healthy Homes Compliance so important?

A majority of households rent from New Zealand and Khandallah, and research indicates that rental homes are more likely to be older, colder, are not as effective heating and have lower quality than homes that are owned by the owner.

The damp, cold and mouldy homes can have negative health outcomes, especially for ailments like colds and flu, asthma and cardiovascular diseases. In addition, people who have reported four or more major housing quality problems frequently have less satisfaction in their lives and lower psychological well-being.

Enhancing the quality of Khandallah rental property will allow tenants to enjoy improved mental and physical health and minimise the disruptions to their work, education and living due to illnesses. Your investment will also be better protected from mould, mildew and damp damage, meaning lower costs for maintenance in the long run.

The Healthy Homes Standard is a list of the specific and minimum standards for heating, insulation Ventilation and Ventilation and Drainage, as well as Draught stopping within Khandallah rental properties.

Unreasonable Gaps & Holes

Draught Stopping Khandallah

Draughts increase the likelihood of lower temperatures in houses. A draughty house is more expensive to heat, meaning wasting energy and resulting in higher bills.

If a draught is felt from unreasonable gaps or holes or holes, it requirements to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught out of a hole or gap or crack, then it is likely to be a gap or an opening that needs sealing in any way. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that let air into or out of your home require seals. In the case of an open fireplace isn’t being used, it can cause draughts and should be sealed off. Property managers and landlords are responsible for ensuring that these draughts are stopped as far as imaginable.

You don’t require to cover up holes or gaps in the building. For example, tiny gaps around windows and doors could be required to allow for movement of the building when the house warms and cools in order to let them be closed and opened rather instead of being stuck. We will inspect every window and door in your Healthy Homes assessment of your rental property.

Heating Khandallah

Rental properties in Khandallah should have a permanent source of heat that can warm the largest or main living space to a minimum of 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements that it be permanently fixed (i.e., not portable) with at least 1.5 kW of heating capacity, and must meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool can be used to determine whether the existing permanent heater(s) are adequate or whether you will need to "top up" with a new heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters are not considered to be suitable heating options in the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it must include an thermostat. This will help make your heating more consistent and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like small apartment buildings the smaller fixed electric heater could be enough.

If your living space already has a fixed heating source such as a heat pump, then it may require an upgrade to ensure it meets the requirements. Some types of heaters can’t be used to comply with the quality since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Khandallah

Each liveable space in a rental property has to contain at minimum one open windows or an exterior door to provide natural ventilation. In addition, high moisture areas like kitchens and bathrooms need to have an externally vented extractor fan to get rid of moisture.

A ventilation standard is all about acknowledging how dry air is easier to heat and that a well ventilated rental property is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t considered liveable , and thus don’t require an opening door or window.

Each window, door , or skylight needs to be able of opening to the outside and remain fixed in an open position in order to allow the circulation of fresh air and air flow.

The bathrooms in all kitchens and every other room of your home with a bath, shower cooker or any other moisture-producing item will need adequate extractor fans that vent to the outdoors. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space with the right extractor fan in areas with high moisture.

Insulation Khandallah

Ceiling and underfloor insulation is mandatory on all rental houses since 1 July 2019. All landlords and property managers have to make sure that the insulation is in line with the new standard. In some instances, an existing insulation on the ceiling or in the subfloor space might require to be replaced or replaced.

A well-insulated property can help control condensation and lessen the likelihood of mould and dampness, as well as making it easier for the house to keep the heat.

Insulation requirements to meet the R-values required for your area

The "R" refers to thermal resistance, and is a measure of how well insulation can withstand heat flow. The more R-value is higher, the higher the standard of insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the remainder area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3

Khandallah Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the inside of the building but you must make sure there is somewhere for surface, rain as well as groundwater to move, and to prevent it from getting into the building. When it comes to moisture and damp it is usually what you don’t see that can become a big problem and end up causing the property to suffer and harming your tenant’s health.

Rental properties should have effective drainage to get rid of the stormwater and surface waters, and ground water, including an appropriate outfall or runoff. Making sure that the water has a proper place to go and that it isn’t allowed to remain beneath buildings is an essential part of maintaining your property’s dry.

In addition to an irrigation system to stop the ingress of moisture, if your rental has an enclosed gap between your floor and soil, a ground-water barrier should be put in place if it is reasonably practicable to install it.

Ground moisture barriers are usually a sheet of polythene that is placed over the ground to stop any moisture from the ground from rising into the property. It also helps to prevent from causing damage to the flooring insulation.
