Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Khandallah rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

The person responsible to pay this fine is the one who is listed on the tenancy agreement as the one who is letting the property out and it could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is executed, and it is updated through the tenancy period as relevant work gets completed.

It’s crucial to keep in mind that landlords who own multiple rental properties could face more severe penalties for not complying. The harshest penalties are handed down for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.

When do I need to be in compliance with the Healthy Homes Standards?

Khandallah Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory for all Khandallah and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to the Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Khandallah

Khandallah rental properties require a reliable source of heating which can warm the main or largest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e. not portable) that is, at least 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity for the main living space. For most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, such as small apartments small apartments, a smaller electric fixed heater may suffice.

If the living area already has a central heating source like an air conditioner, it could need some additional energy to meet the standards. Some types of heaters can’t be used to comply with the standard as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Khandallah

Property managers and landlords should make sure that the insulation is in line with standards that are in line with the latest standard.
