Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Karori rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or the property manager doesn’t provide the information requested within 21 days of being informed of the request, they will be issued an infringement notice and be fined up to $750.

Furthermore, there’s also a penalty of as much as $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the lease agreement as being the person who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be current when the tenancy contract is completed, and is updated throughout the tenancy as any related work is completed.

It’s also important to note that landlords with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down for severe violations. Those who have six or more properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Karori Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement to all Karori and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate conformance with all Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Heating Karori

Karori rental properties must have a fixed source of heat that can heat the main or largest living space to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements to remain fixed (i.e. not portable) that is, at least 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity to heat the living space in general.
