Fines for Failing to Comply

What time Do I need to be in compliance with the Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required for all Karori and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to the Healthy Homes Standard that apply or will be applied during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Draughts are a major cause of lower temperatures in homes. A cold home will cost more to heat, which means wasting money and energy.

What are unreasonable gaps or holes?

If you can feel external air flowing in or the air is clear out of a hole or gap that is, it is likely to be a gap or hole which requirements sealing in somehow. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that let air into or out into the house need seals. For example, if the open fireplace is not in use, it could cause draughts, and should be sealed from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed whenever possible.

You don’t need to block off gaps or holes that are part of the construction. For example, tiny gaps around doors and windows could be necessary to allow for the movement of the building when the home heats and cools, to allow them to be closed and opened instead of than being stuck. A good heating system is crucial to ensure healthy houses

Heating Karori

Karori rental properties must have a fixed heating source that can warm the largest or main living room to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to remain fixed (i.e., not portable), at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to check if the existing permanent heater(s) are adequate or if you’ll need to "top up" with an additional heater. Fires that are open and unflued heaters like mobile LPG bottle heaters are not considered to be safe heating options for The Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it should be equipped with a thermostat. This makes the heating more consistent and effective. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, such as small apartments, a smaller fixed electric heater may be sufficient.

If the living area is already equipped with a fixed heating source, such as the heat pump, it could need a top up in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Karori

Insulation Karori

The insulation of the ceiling and underfloor is required for all rent homes from 1 July 2019. Property managers and landlords should ensure the insulation meets this new standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space might require to be topped up or replaced.
