Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Karori rental property, all Healthy Homes compliance tasks must be completed within 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on a Karori rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to supply the information requested within 21 days of having received the inquiry, they can receive an infringement notification and be fined as high as $750.

Additionally, there is also a fine of as much as $900 for property owners or property managers who offer a false or incorrect Healthy Homes Compliance Statement or other information. The person liable to pay this fine is the one who is named on the lease agreement as being the person letting the property out, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it is updated through the tenancy period as relevant work gets completed.

It’s important to remember that a landlord who manage several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down for the most serious violations, and landlords who own six or more properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.

In the end, a failure to adhere to your Healthy Homes requirements can hit your pocket and result in huge fines, in addition to having to continue to comply. Don’t put your rental at risk. property Contact us now and make arrangements to have a home inspection performed on your rental property.

Healthy homes matter

What is the reason Healthy Homes Compliance so important?

Around 1 in 3 households in New Zealand and Karori, and research suggests that rental houses are likely to be colder, older, have less efficient heating, and generally have lower quality than houses that are owned by the owner.

The damp, cold and mouldy homes can have negative health outcomes, particularly for ailments like colds and flu, asthma and heart diseases. Additionally, those who report at least four key issues with their housing often have low life satisfaction and reduced mental health.

Unreasonable Gaps & Holes

Draught Stopping Karori

Draughts are a major cause of less temperature in households. A humid house is more expensive to heat, meaning wasting energy and incurring higher costs.

If a draft can be perceived as a result of gaps or holes that it needs to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the air is clear from a hole or gap or crack, then it’s likely to be a gap or hole that needs sealing in somehow. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that allow air to enter or exit of the home require sealing. For example, if the open fireplace is not in use, it can cause draughts and should be blocked off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as far as imaginable.

You don’t require to block up intentional gaps or holes which are part of the building. For example, tiny gaps around windows and doors could be required to allow for movement within the structure as the house is heated and cools so that they are able to be shut and opened, rather than sticking. We will test every window and door in the Healthy Homes assessment of your rental property.

Heating Karori

Rental properties in Karori must have a fixed source of heating that can heat the main or largest living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool could be used to determine if your current fixed heater(s) are sufficient or whether you will need to "top up" by adding a second heater. Fires that are open and unflued heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump then it must have a thermostat. This will make your heating more consistent and effective. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like apartments with small spaces an electric, fixed heater might be enough.

If your living space is already equipped with a fixed heating source, like an air conditioner, it could need some additional energy to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard because they’re costly, not affordable to run, or unsafe to operate.

Ventilation Karori

Each liveable space in a rental property has to have at least one openable windows or an exterior door to offer natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an externally vented extractor fan to remove moisture.

The ventilation quality is all about recognising it is that the dry atmosphere is much easier to heat and that a well ventilated rental property is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are considered liveable areas. Connecting spaces such as the hallway aren’t considered living spaces and therefore are not need an opening window or door.

Every window, door or skylight requirements for them to be in a position to open up to the outside, but remain set in an opening position to allow ventilation and fresh air air flow.

The bathrooms in all kitchens and any other area in your home with a bath, shower, cooktop or other high water-generating appliance will require adequate extractor fans that are vented to the outdoors. Our Healthy Homes Assessment service will make sure there is sufficient ventilation in every living space with the right extractor fan for areas that are high in moisture.

Insulation Karori

The insulation of the ceiling and underfloor has been compulsory to all rental houses from 1 July 2019. All landlords and property managers should ensure that the insulation is up to this new quality. In some cases, existing ceiling insulation or insulation in the subfloor space might require to be topped up or replaced.

A well-insulated house will reduce the risk of condensation and lessen the likelihood of mould and dampness and will also make much easier for the home to keep heat.

Insulation needs to meet the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance, and it is a measurement of how well insulation is able to resist heat flow. The more R-value is higher, the more efficient the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3, underfloor R 1.3

Karori Moisture Ingress & Drainage

The security of your rental home from moisture isn’t just about the interior of the building it is also about the outside. You must ensure there is somewhere for rain, surface as well as groundwater to move, and stop it from coming inside. When it is about damp and water, it’s frequently the things you don’t notice that could be a huge problem that can cause the property to suffer and affecting your tenant’s health.

Rental properties should be equipped with efficient drainage for the removal of storm water, surface water and groundwater, with an appropriate outfall or runoff. Making sure that water has a location to go, and that it doesn’t get sucked into structures is an crucial aspect of keeping your property dry.

Alongside an irrigation system to stop water ingress, if the rental is enclosed between the floor and ground, a ground moisture barrier must be put in place when it’s reasonably practicable to do so.

An underground moisture barrier typically a polythene sheet laid over the ground to stop any moisture that is present in the ground from rising into the building. It also helps in preventing any damage to your underfloor insulation.
