Fines for Failing to Comply
As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not supply the necessary information within 21 days from having received the inquiry, they will receive an infringement notice and be fined up to $750.
In addition, there is also a penalty up to $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or information. The person who is responsible for this fine is whoever is named on the lease agreement as the one who is letting the property out which could be the name of the landlord as well as the company that manages the property.
All the information on the Statement of Compliance requirements to be accurate before the tenancy agreement can be completed, and should be kept updated throughout the duration of the tenancy when any associated work has been completed.
It’s also important to keep in mind that landlords who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for serious breaches, and landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in hearings.
