As of 1st July 2021, when a brand new or renewed Tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to comply with each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.
Anyone can request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of having received the inquiry, they may receive an infringement notice and could be fined up to $750.
In addition, there is also a fine of up to $900 for landlords or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord, or the property management company.
The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is executed, and it should be maintained through the tenancy period as relevant work gets completed.
It is important to note that landlords who own several rental properties can face additional fines for non-compliance. The highest penalties are reserved for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.
In the end, a failure to comply with your Healthy Homes requirements can hit your bank account hard, resulting in large fines in addition to continuing to be required to comply with the requirements.
