Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance items have to be taken care of within 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on the Karaka Bays rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to supply the required information within 21 days from getting the notice, the tenant will receive an infringement notification and be fined as high as $750.

In addition, there is also a fine of approximately $900 for landlords or property managers who offer a false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as the one who is leasing the property out, so it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is executed, and it should be kept updated during the entire tenancy, as related work is completed.

It’s also crucial to note that landlords who have multiple rental properties could face additional fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Karaka Bays and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

From 1 July 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

What are unjustifiable gaps or holes?

If you can feel external air entering or a clear draught out of a hole or gap or crack, then it is likely a crack or hole which requirements sealing in the way you can. Cracks or gaps with large gaps must be sealed permanently. Cracks that are greater than 3mm and let air into or out of the home need seals. For example, if an open fireplace isn’t being used, it may cause draughts and should be blocked off. There is no need to block gaps or holes that are part of the building. Heating Karaka Bays

Karaka Bays rental properties require a reliable source of heat that can warm the living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to be fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the existing fixed heater(s) are adequate or whether you will need to "top up" with an additional heater. If the heating system you provide is electric heating or heat source, then it must include the thermostat. This makes the heating more uniform and efficient. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a central heating source such as heat pumps, it may require a top up in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Karaka Bays

Ceiling and underfloor insulation is mandatory on all rental homes since 1 July 2019. All landlords and property managers should ensure the insulation meets standards that are in line with the latest standard. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be filled with or replaced.
