Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Karaka Bays rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.
Since the 1st July of 2021, when a new, renewed or varied lease is entered into on the Karaka Bays rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, there may be additional penalties or an infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the necessary information within 21 days from receiving the request, they will receive an infringement notification and be fined as high as $750.
In addition, there is an additional fine of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is identified on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord as well as the property management company.
All information in the Compliance Statement needs to be up-to-date when the tenancy contract is completed, and is updated through the tenancy period as related work is completed.
It’s crucial to keep in mind that landlords who own multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down for serious violations. Those who have at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.
