Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Kaiwharawhara rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. It is important to remember that landlords who have several rental properties can face greater penalties for non-compliance. The most severe penalties are given for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

When will I need to be in compliance with The Healthy Homes Standards?

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required for all Kaiwharawhara and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standard that apply or will apply throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Kaiwharawhara must have a fixed source of heating that is able to heat the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. For the majority of homes, bigger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like small apartments an electric, fixed heater may be sufficient.

If the living area is already equipped with a fixed heating source, such as an air conditioner, it could require some additional energy in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality as they are either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Kaiwharawhara

Every living space in a rental property must include at least one open doors or windows to provide natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an venting fan outside to get rid of moisture.
