Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

If the property manager is unable to provide the information requested within 21 days of being informed of the request, they will receive an infringement notification and could be fined up to $750.

In addition, there is also a fine of up to $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord, or the property management company.

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required to all Kaiwharawhara and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From July 1st 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Rental properties in Kaiwharawhara need to have a stable source of heat which can warm the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days.
