Additionally, there is also a penalty up to $900 for landlords and property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is identified on the tenancy contract as the person renting the property which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and is updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to keep in mind that landlords who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down only for serious breaches, and landlords with six or more properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement to all Kaiwharawhara and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with all Healthy Homes Standard that apply or will be applied to their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
