Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Kaiwharawhara rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required in all Kaiwharawhara and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standard that apply or will be applied throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
