Fines for Failing to Comply
From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance items need to be finished inside of 90 days.
As of 1st July 2021, when a brand new, renewed or varied contract is signed on the Kaiwharawhara rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to comply with one of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement, there could be additional penalties or an infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to provide the information requested within 21 days of being informed of the request, they will receive an infringement notification and could be fined up to $750.
In addition, there is also a fine of up to $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord, or the property management company.
All the information on the Statement of Compliance requirements to be up-to-date when the tenancy agreement is completed, and should be kept updated throughout the duration of the tenancy when any associated work has been completed.
It is important to keep in mind that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for severe violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.
