Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance items have to be completed within 90 days.

Beginning on July 1st, 2021, once a new or renewed Tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

When should I require to be in compliance with my Healthy Homes Standards?

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Kaiwharawhara and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standards that apply or will be applied to an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in houses. A damp house costs more to heat, resulting in wasted money and energy.

If a draught can be perceived as a result of gaps or holes or holes, it needs to be closed.

Heating Kaiwharawhara

Rental properties in Kaiwharawhara must have a fixed source of heat that is able to heat the largest or main living space to at least 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements to be fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity for the main living space. If the heating system you provide is electric heating or heat source, it needs to be equipped with the thermostat. This will help make the heating more uniform and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces an electric, fixed heater may suffice.

If the main living room already has a central heating source such as an air conditioner, it might just require an update to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality since they’re either not effective, cost prohibitive to operate or are unsafe to operate.

The insulation of the ceiling and underfloor is required on all rental homes from 1 July 2019. Property managers and landlords must ensure that the insulation is in line with this new standard.
