Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Houghton Bay rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

As of 1st July 2021, if a new or renewed contract is signed on a Houghton Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Houghton Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate compliance with any Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Houghton Bay need to have a stable source of heat that can heat the living space to a minimum of 18degC, even during the most coldest days of the year.
