Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance work need to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement, there could be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to provide the required information within 21 days of being informed of the request, they will be issued an infringement notice and could be fined up to $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is listed on the tenancy agreement as being the person letting the property out and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it must be updated through the tenancy period as associated work has been completed.

It is also important to keep in mind that a landlord who have several rental properties can face even higher fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Highbury and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their compliance with any Healthy Homes Standard that apply or will apply to the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Highbury rental properties require a reliable heating source which can warm the largest or main living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs to remain fixed (i.e., not portable), at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to check if the permanent heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered acceptable heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat pump it should be equipped with a thermostat. This will help make your heating more consistent and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases like small apartments an electric, fixed heater may be sufficient.

If your main living space is already equipped with a fixed heating source such as heat pumps, it may need an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Highbury

Each liveable space in a rental property must contain at minimum one open window or exterior door to provide natural ventilation. In addition, humid spaces like kitchens and bathrooms need to have an externally vented extractor fan to take moisture away.
