Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not provide the information requested within 21 days of receiving the request, they could receive an infringement notification and be fined as high as $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the person who is listed on the tenancy contract as the person leasing the property out which could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is completed, and should be maintained through the tenancy period as necessary work related to it is finished.

It is crucial to remember that a landlord who have multiple rental properties may receive additional fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Highbury Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required throughout Highbury and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with each Healthy Homes Standards that apply or will be applicable to an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Highbury

Highbury rental properties should have a permanent heating source which can warm the main or largest living space to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements to be fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed for the main living room. For most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, such as small apartments small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a permanent heating source, like heat pumps, it could need a top up in order to comply with the standards. Certain types of heaters cannot be used to meet the standard because they’re not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Highbury
