Healthy Homes Assessment Services

Did you have any idea that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure their Highbury rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewed or new tenancy and all private rental properties must be completely in compliance by July 1st 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work must be completed within 90 days.

From the 1st of July in 2021, once a new or renewed Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, it could result in an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of receiving the request, they will receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the one who is renting the property and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy contract is signed, and ideally it is updated throughout the tenancy as any relevant work gets completed.

It’s crucial to note that landlords who manage multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have six or more properties can be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Highbury and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be in force to an apartment rental.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

Draughts may lead to lower temperatures in homes. A damp house costs more to heat, meaning wasting energy and resulting in higher bills.

If a draft can be noticed from gaps that are not adequate or holes, it requirements to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a gap or hole, then it is most likely a gap or hole which needs sealing in some way. Cracks and gaps that are large should be fixed permanently. Any gaps greater than 3mm that allow air in or out within your home need seals. For example, if the open fireplace isn’t being used, it can create draughts. This should be blocked from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as far as possible.

You don’t require to block up intentional holes or gaps in the building. For example, tiny gaps around doors and windows may be required to allow for the movement of the structure when the household gets warmer and cooler, so that they are able to be closed and opened rather than sticking. Heating Highbury

Highbury rental properties must have a fixed source of heat which can warm the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to be fixed (i.e. not portable), at least 1.5 kW of heating capacity, and meet the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to check if the fixed heater(s) are adequate or whether you will need to "top up" with an additional heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters are not considered to be suitable heating options under the Healthy Homes Standard.

If the heating you provide is an electric heater or heat source, it should include the thermostat. This will help make the heating more uniform and effective. For most properties, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments, a smaller fixed electric heater could be enough.

If your main living space already has a central heating source like heat pumps, it may need a top up in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard as they are either expensive, inefficient and/or unsafe to run.

Ventilation Highbury

Each living space within the rental property should have at least one opening window or exterior door to provide natural airflow. In addition, high moisture areas like kitchens and bathrooms need to have an venting fan outside to take moisture away.

The ventilation quality is all about acknowledging that the dry atmosphere is less difficult to heat and a property that is well ventilated is less likely to grow mould and damp.

Bedrooms, living rooms, dining rooms, and kitchens are considered liveable spaces. Connecting spaces like the hallway aren’t liveable and do not require an opening door or window.

Each window, door or Skylight needs for them to be in a position open to the outside while remaining closed, allowing the circulation of fresh air and air flow.

All bathrooms and kitchens and any other area in your property with a bath, shower and cooktop or another humidity-generating items will require adequate extractor fans that can be vented out to the outside. Insulation Highbury

Ceiling and underfloor insulation is required on all rental homes from 1 July 2019. All landlords and property managers have to make sure the insulation meets the new quality. In some cases, old ceiling insulation as well as insulation within the sub floor space may need to be topped up or replaced.

A well-insulated house will help to control condensation and lessen the likelihood of mould and damp, and will also make much easier to allow the home to hold heat.
