Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement, there may be an additional fine or violation fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager does not supply the required information within 21 days from having received the inquiry, they can be issued an infringement notice and be fined up to $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the person who is named on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It is important to note that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down for severe breaches. Landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement for all Highbury and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their conformance with each Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy began.

Highbury rental properties need to have a stable source of heat which can warm the living space to at least 18degC, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs that it be permanently fixed (i.e., not portable), at least 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity for the main living space.
