Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed contract is signed on a Highbury rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Highbury Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required for all Highbury and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
