Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Grenada Village rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on the Grenada Village rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they live in. If the property manager does not provide the necessary information within 21 days of having received the inquiry, they could be issued an infringement notice and be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is liable to pay this fine is the one who is named on the lease agreement as the one who is letting the property out and it could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be correct when the tenancy contract is executed, and it must be updated throughout the duration of the tenancy when any related work is completed.

It is important to keep in mind that a landlord who manage multiple rental properties could face more severe penalties for not complying. The harshest penalties are given for severe violations. Those who have at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Grenada Village and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the compliance with the Healthy Homes Standards that apply or will apply during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Grenada Village

Grenada Village rental properties should have a permanent source of heating that is able to heat the living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements to remain fixed (i.e. not portable), at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine if the existing fixed heater(s) are sufficient or whether you will need to "top-up" with an additional heater. If the heating you offer is electric heating (or heat pump), it must have a thermostat. This will make the heating more reliable and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, like apartments with small spaces an electric, fixed heater may be sufficient.

If the main living room already has a fixed heating source like heat pumps, it might require some additional energy to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either expensive, inefficient and/or unsafe to run.

Ventilation Grenada Village
