Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed for a Grenada Village rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Grenada Village rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement there could be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager fails to supply the information requested within 21 days from having received the inquiry, they may receive an infringement notice and be fined up to $750.

In addition, there is also a penalty as much as $900 for landlords or property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The highest penalties are reserved only for serious violations, and landlords who own six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory to all Grenada Village and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Proper heating is crucial for well-being homes

Heating Grenada Village

Grenada Village rental properties must have a fixed heating source that can heat the largest or main living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool could be used to determine whether the installed heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Open fires as well as unflued combustion heaters, such as mobile LPG bottle heaters are not considered acceptable heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), then it must have an thermostat. This will make the heating more uniform and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, such as small apartments, a smaller fixed electric heater might be enough.

If the main living room is already equipped with a fixed heating source, like heat pumps, it may need a top up to make sure it meets the requirements. Some types of heaters can’t be used to comply with the standard because they’re inefficient, unaffordable to operate or unsafe to operate.

Ventilation Grenada Village

Insulation for underfloor and ceilings is mandatory in all rental houses since 1 July 2019. All landlords and property managers should make sure that the insulation is up to standards that are in line with the latest quality. In some cases, existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.
