Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Grenada Village rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

Since the 1st July of 2021, when a new or renewed contract is signed on a Grenada Village rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to supply the required information within 21 days from having received the inquiry, they will receive an infringement letter and could be fined up to $750.

Additionally, there is also a fine of up to $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as the person who is who is letting the property, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be current when the tenancy contract is signed, and ideally it must be updated during the entire tenancy, as associated work has been completed.

It’s important to note that landlords who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given only for serious violations. Those who have more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory for all Grenada Village and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with the Healthy Homes Standards that apply or will be applied to their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Draughts may lead to less temperature in houses. A damp home is more expensive to heat, meaning wasting money and energy.

If a draft can be perceived as a result of gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming from a gap or hole or crack, then it is probably a gap or crack that requirements sealing in any way. Large gaps and cracks should be fixed permanently. Gaps greater than 3mm that allow air in or out into the house require to be sealed. For example, if the open fireplace isn’t being used, it can create draughts. This should be sealed off. Heating Grenada Village

Rental properties in Grenada Village need to have a stable heating source which can warm the living space to at least 18degC even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

Ventilation Grenada Village
