Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Grenada North rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on a Grenada North rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not provide the required information within 21 days from getting the notice, the tenant could receive an infringement notification and could be fined up to $750.

Furthermore, there’s also a fine of as much as $900 for landlords or property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy contract as the person letting the property out, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s crucial to keep in mind that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved for severe violations. Those who have six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Grenada North Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required for all Grenada North and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with each Healthy Homes Standards that apply or will be in force to the rental property.

Starting 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts may lead to dropping temperatures within houses. A draughty house costs more to heat, which results in wasting money and energy.

If a draught is perceived as a result of gaps or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught from a crack or a gap or crack, then it is likely a crack or crack that needs sealing in the way you can. Adequate heaters are important for healthy homes

Heating Grenada North

Grenada North rental properties should have a permanent source of heat that can warm the main or largest living space to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs to be fixed (i.e. not portable) and at least 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether your current fix heater(s) are sufficient or if you’ll need to "top up" with a new heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat source, it must include the thermostat. This makes your heating more consistent and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. In certain situations, like small apartments the smaller fixed electric heater may be sufficient.

If the living area is already equipped with a fixed heating source, such as the heat pump, it might need some additional energy to meet the standards. Some types of heaters can’t be used to comply with the standard because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Grenada North

Every living space in a rental property has to include at least one open doors or windows to offer natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms should have an externally vented extractor fan to eliminate moisture.

Insulation Grenada North

Underfloor and ceiling insulation is mandatory to all rental homes as of July 1st, 2019. All landlords and property managers are required to make sure the insulation meets the new quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may need to be replaced or replaced.
