Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Grenada North rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.
As of 1st July 2021, once a new, renewed or varied Tenancy is signed for the Grenada North rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to adhere to any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.
Anyone can request details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days from getting the notice, the tenant could be issued an infringement notice and be fined upto $750.
In addition, there is also a penalty of up to $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is renting the property and it could be the name of the landlord, or the property management company.
The information contained in the Statement of Compliance needs to be up-to-date when the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it’s finished.
It’s crucial to note that a landlord who manage several rental properties can face even higher fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.
