Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Grenada North rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on the Grenada North rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from getting the notice, the tenant could receive an infringement letter and be fined up to $750.

Furthermore, there’s also a penalty up to $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person responsible for this fine is the one who is named on the tenancy agreement as the person who is renting the property and it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and should be kept updated throughout the tenancy as any relevant work gets completed.

It is also crucial to be aware that landlords who have several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down for serious breaches, and landlords with six or more properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Grenada North Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required throughout Grenada North and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with each Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

What are unreasonable gaps and holes?

If you can feel external air entering or the air is clear from a hole or gap and you are able to feel it, it’s likely to be a gap or hole which requirements sealing in any way. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that let air in or out into your home require sealing. For example, if the open fireplace isn’t being used, it can create draughts. This should be blocked off. There is no need to block holes or gaps that are part of the building. Heating Grenada North

Rental properties in Grenada North need to have a stable source of heat that can warm the living area to at minimum 18degC even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs that it be permanently fixed (i.e., not portable) and at minimum 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine if the existing installed heater(s) are adequate or if you’ll need to top up with an additional heater. Fires that are open and unflued heaters, such as small portable LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is electric heating or heat source, it must be equipped with a thermostat. This will make the heating more consistent and efficient. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like apartments with small spaces, a smaller fixed electric heater may suffice.

If your living space is already equipped with a fixed heating source, such as the heat pump, it might just require an upgrade in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality since they’re either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Grenada North
