Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Grenada North rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

The person who is liable for this fine is the one who is identified on the tenancy agreement as the one who is renting the property and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also crucial to be aware that landlords with multiple rental properties could face additional fines for non-compliance. The most severe penalties are given only for serious violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Grenada North Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required throughout Grenada North and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with any Healthy Homes Standards that apply or will be in force during the tenure of your rental home.

From 1 July 2021

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Rental properties in Grenada North require a reliable heating source that can warm the principal or the biggest living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

All landlords and property managers are required to ensure the insulation meets standards that are in line with the latest standard.
