Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Grenada North rental property, all Healthy Homes compliance work need to be taken care of inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed Tenancy is signed for a Grenada North rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement there may be an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t supply the information requested within 21 days of being informed of the request, they can receive an infringement letter and be fined as high as $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the one who is renting the property and it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current before the tenancy agreement can be signed, and ideally it should be maintained throughout the tenancy as any associated work has been completed.

It is important to be aware that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down for serious breaches. Landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Grenada North Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory to all Grenada North and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Grenada North

Grenada North rental properties need to have a stable source of heating that is able to heat the living area to at minimum 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to remain fixed (i.e. not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity in the living area.
