Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for a Grenada North rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Grenada North rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they may receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the one who is named on the lease agreement as the one who is renting the property It could also be the name of the landlord, or the property management company.

All information in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It must be updated through the tenancy period as necessary work related to it’s finished.

It is also important to remember that landlords with multiple rental properties may receive greater penalties for non-compliance. The highest penalties are handed down for severe violations. Those who have six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.

When do I need to be in compliance with requirements of the Healthy Homes Standards?

Grenada North Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement throughout Grenada North and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Landlords and property managers are responsible for making sure such draughts are eliminated in the maximum extent possible.

There is no need to block up intentional gaps or holes which are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for movement of the structure as the home heats and cools, to allow them to be closed and opened rather instead of being stuck. Heating Grenada North

Rental properties in Grenada North must have a fixed heating source which can warm the principal or the biggest living space to at least 18degC, even during the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living room.
