Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Glenside rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

In addition, there is also a fine of approximately $900 for property owners or property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property which could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It must be updated throughout the tenancy as any associated work has been completed.

It is important to be aware that landlords who manage multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

When Do I require to be in compliance with The Healthy Homes Standards?

Glenside Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement for all Glenside and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with any Healthy Homes Standards that apply or will be in force throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
