Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Glenside rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied Tenancy is signed for a Glenside rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there may be an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the information requested within 21 days from having received the inquiry, they may receive an infringement letter and be fined as high as $750.

In addition, there is also a penalty approximately $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is identified on the tenancy contract as the person leasing the property out and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement needs to be accurate when the tenancy agreement is completed, and must be updated throughout the tenancy as any relevant work gets completed.

It’s important to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for serious breaches. Landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Glenside Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Glenside and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with each Healthy Homes Standard that apply or will apply to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Glenside

Glenside rental properties must have a fixed source of heat that can heat the largest or main living space to a minimum of 18degC even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs that it be permanently fixed (i.e. not portable) and at least 1.5 kW in heating capacity, and meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump it needs to have a thermostat. This will help make your heating more consistent and efficient. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like apartments with small spaces an electric, fixed heater could be enough.

If the living area is already equipped with a fixed heating source, like heat pumps, it could require a top up in order to comply with the standards. Certain kinds of heaters cannot be utilised to meet the standard since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Glenside

Underfloor and ceiling insulation is a requirement on all rental homes from 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with this new quality.
