Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Glenside rental property, all Healthy Homes compliance items need to be done inside of 90 days.

The person liable for this fine is whoever is named on the lease agreement as the person who is letting the property out, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance requirements to be accurate when the tenancy contract is executed, and it must be updated throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to keep in mind that landlords who own several rental properties can face even higher fines for non-compliance. The highest penalties are given for severe breaches. Landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Glenside Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory in all Glenside and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From 1 July 2021

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Glenside

Glenside rental properties should have a permanent source of heating that can heat the largest or main living area to at minimum 18degC, even on the winter coldest days. In some instances, like small apartments the smaller fixed electric heater may be sufficient.

If your living space already has a permanent heating source, like the heat pump, it may require an upgrade to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to comply with the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Glenside
