Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Crofton Downs rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

It is also crucial to keep in mind that landlords who manage multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for the most serious breaches. Landlords with six or more properties could be fined up to $50,000, or as high as $100,000 in hearings.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Crofton Downs and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Crofton Downs

Crofton Downs rental properties need to have a stable source of heating that can heat the main or largest living space to at least 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to remain fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or whether you will require to ‘top up’ with an additional heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it should be equipped with the thermostat. This makes the heating more consistent and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces the smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source, such as a heat pump, then it may require an update to meet the standards. Some types of heaters can’t be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Crofton Downs
