Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Crofton Downs rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

Since the 1st July of 2021, once a new or renewed lease is entered into on a Crofton Downs rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, it could result in an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from having received the inquiry, they will be issued an infringement notice and be fined upto $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is whoever is named on the tenancy agreement as being the person renting the property, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be correct before the tenancy agreement can be completed, and should be maintained through the tenancy period as associated work has been completed.

It’s crucial to note that a landlord with multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given only for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Crofton Downs and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

For example, if an open fireplace is not in use, it could cause draughts, and should be shut off. Property managers and landlords are responsible for ensuring that these draughts are stopped as much as possible.

You don’t need to block holes or gaps that are part of the construction. For instance, small gaps around windows and doors could be required to allow for movement of the building as the household is heated and cools so that they can still be closed and opened rather than securing. Heating Crofton Downs

Rental properties in Crofton Downs must have a fixed source of heating that can warm the principal or the biggest living room to at least 18degC, even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If your main living space already has a central heating source, like the heat pump, it could require some additional energy in order to comply with the standards. Some types of heaters can’t be used to achieve the quality because they’re expensive, inefficient or unsafe to operate.

Ventilation Crofton Downs
