Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Crofton Downs rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on the Crofton Downs rental property, all Healthy Homes compliance work must be completed within 90 days.

It is also important to note that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given for the most serious violations. Those who have six or more properties can be fined as high as $50,000, or as high as $100,000 in hearing claims.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Crofton Downs and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to the Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Crofton Downs

Crofton Downs rental properties should have a permanent source of heating that can warm the main or largest living area to at minimum 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e., not portable) with at least 1.5 kW in heating capacity, and it must have the minimum required heating capacity to heat the living space in general. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered to be suitable heating options under The Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, then it must be equipped with an thermostat. This will help make the heating more uniform and efficient. For most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, such as small apartments, a smaller fixed electric heater may suffice.

If your living space already has a permanent heating source, such as heat pumps, it might just need a top up to be able to meet the standards. Certain types of heaters cannot be used to meet the standard as they are either costly, not cost-effective to run, and/or unsafe to run.
