Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Breaker Bay and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to all Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts may lead to dropping temperatures within homes. A draughty house costs more to heat, meaning wasting money and energy.

If a draught is noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a hole or gap and you can feel it, it’s probably a gap or hole that needs sealing in any way. Cracks and gaps that are large should be sealed permanently. The gaps that exceed 3mm that let air into or out from your house require to be sealed. For example, if the open fireplace isn’t being used, it could cause draughts, and should be sealed off. Property managers and landlords are accountable for ensuring such draughts are eliminated in the maximum extent possible.

There is no need to cover up gaps or holes in the construction. For example, tiny gaps around doors and windows may be required to allow movement of the building as the home heats and cools, in order to let them be shut and opened, rather than securing. Heating Breaker Bay

Breaker Bay rental properties need to have a stable source of heat which can warm the main or largest living space to at least 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to remain fixed (i.e., not portable) with at least 1.5 kW of heating capacity and have the minimum required heating capacity for the main living room. A Heating Assessment Tool could be used to determine if the fix heater(s) are sufficient or if you’ll need to top up with an additional heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be safe heating options in The Healthy Homes Standard.

If the heating that you provide is electric heating or heat source, then it must have a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If your living space already has a central heating source such as a heat pump, then it may require some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Breaker Bay

Every living space in a rental home must include at least one open door or window to provide natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an venting fan outside to eliminate moisture.

Insulation Breaker Bay

Ceiling and underfloor insulation has been compulsory to all rental homes since July 1, 2019. Property managers and landlords are required to ensure that the insulation is up to this new quality. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be topped up or replaced.
