Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

As of 1st July 2021, if a new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy contract, there could be additional penalties or an infringement fee.

Those who have six or more properties can be fined as high as $50,000, and as much as $100,000 in hearing claims.

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement in all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to all Healthy Homes Standard that apply or will apply throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of lower temperatures in households. A draughty house is more expensive to heat, which results in wasting energy and resulting in higher bills.

Heating Breaker Bay

Breaker Bay rental properties need to have a stable source of heat that is able to heat the largest or main living area to at minimum 18degC even on the winter coldest days. For most homes, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like small apartment buildings the smaller fixed electric heater could be enough.

If the living area already has a fixed heating source, like an air conditioner, it might just need an update in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either expensive, inefficient and/or unsafe to run.

Ventilation Breaker Bay

The insulation of the ceiling and underfloor is a requirement to all rental houses as of July 1st, 2019. Property managers and landlords must ensure that the insulation meets the new standard.
