Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

As of 1st July 2021, when a new or renewed Tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory throughout Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
