Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be finished within 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on the Breaker Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the necessary information within 21 days from receiving the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is identified on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.

It is also important to be aware that landlords who have multiple rental properties may receive additional fines for non-compliance. Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or modified tenancy agreement.

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Adequate heaters are crucial for well-being houses

Heating Breaker Bay

Breaker Bay rental properties should have a permanent heating source that can warm the largest or main living space to a minimum of 18degC even on the coldest days of the year. Insulation Breaker Bay

The insulation of the ceiling and underfloor is a requirement to all rental homes since 1 July 2019. All landlords and property managers are required to ensure the insulation meets the new quality. In some instances, an existing insulation on the ceiling or in the sub floor space may need to be added or replaced.

A well-insulated property can reduce condensation and reduce the chances of mould and damp, and it will make an easier task to the house to retain the heat.
