Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

It’s important to remember that landlords who have several rental properties can face greater penalties for non-compliance. The highest penalties are given for serious violations, and landlords who own six or more properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties comply to the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Breaker Bay

Rental properties in Breaker Bay must have a fixed heating source that is able to heat the largest or main living space to a minimum of 18degC, even during the winter coldest days.
