Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Berhampore rental property, all Healthy Homes compliance items need to be finished within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Berhampore rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person responsible for this fine is the one who is named on the tenancy contract as the person renting the property which could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be accurate when the tenancy agreement is signed. It must be updated throughout the duration of the tenancy when any related work is completed.

It’s crucial to be aware that a landlord who have multiple rental properties could face even higher fines for non-compliance. The highest penalties are given for severe breaches. Landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Berhampore Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement to all Berhampore and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be in force to their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Berhampore

Rental properties in Berhampore must have a fixed source of heat that can heat the living space to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to be fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed in the living area. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases such as small apartments an electric, fixed heater may be sufficient.

If the living area already has a central heating source such as the heat pump, it may require a top up to ensure it meets the requirements. Certain kinds of heaters aren’t able to be utilised to meet the standard as they are either costly, not cost-effective to run, and/or unsafe to run.
