Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Berhampore rental property, all Healthy Homes compliance work must be done within 90 days.

Beginning on July 1st, 2021, when a new or renewed lease is entered into on the Berhampore rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the required information within 21 days from receiving the request, they could receive an infringement letter and be fined as high as $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the one who is identified on the tenancy agreement as the person who is renting the property It could also be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be correct before the tenancy agreement can be completed, and is updated through the tenancy period as related work is completed.

It is also crucial to remember that a landlord who have several rental properties can face additional fines for non-compliance. The most severe penalties are reserved only for serious breaches, and landlords with more than six properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Clearly, failure to comply with the Healthy Homes requirements can hit your pocket hard, with significant fines and still having to meet compliance. Do not risk your rental property Call us today and make arrangements to have a house assessment done on the rental property you are renting.

Healthy homes matter

Why is Healthy Homes Compliance so important?

One in three households rent from New Zealand and Berhampore, and research shows us that these rental houses are likely to be colder, older and have less effective heating and tend to be of poorer quality than homes that are owned by the owner.

The damp, cold and mouldy homes can have negative well-being results, specifically for illnesses like colds, flu, asthma and cardiovascular issues. Furthermore, people who reported four or more key home quality issues often suffer from low life satisfaction and reduced psychological well-being.

Improve the standard of Berhampore rental property will help tenants experience improved mental and physical health, and lessen the interruption to learning, work and daily life due to illnesses. Your investment is also secured from mildew, mould and damp , which means less costs of maintenance in the long run.

The Healthy Homes Standards are a set of specific and minimal standards for Heating, Insulation Ventilation, Moisture Ingress and Drainage, as well Draught Control in Berhampore rental properties.

Unreasonable Gaps & Holes

Draught Stopping Berhampore

Draughts are a major cause of low temperatures inside houses. A cold house will cost more to heat, resulting in wasted energy and increased bills.

If a draught could be felt through gaps that are too large or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air entering or a clear draught from a hole or gap or crack, then it’s most likely a gap or hole which needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. Gaps greater than 3mm that let air into or out into your home need the sealing. For example, if the open fireplace isn’t used it can cause draughts and should be sealed from. Landlords and property managers are responsible for ensuring that such draughts are squelched as far as possible.

There is no require to block gaps or holes in the building. For example, tiny gaps around windows and doors could be required to allow for the movement of the structure when the house heats and cools, in order to let them be opened and closed rather than sticking. We will test every window and door in our Healthy Homes assessment of your rental property.

Heating Berhampore

Berhampore rental properties require a reliable heating source that can warm the living room to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating requirements to be fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and meet the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool may be used to determine whether your current permanent heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), then it must have an thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like small apartment buildings, a smaller fixed electric heater may suffice.

If your main living space is already equipped with a fixed heating source like heat pumps, it may require a top up in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Berhampore

Every living space in a rental property has to have at least one openable doors or windows to offer natural airflow. In addition, high moisture areas such as kitchens and bathrooms need to have an externally vented extractor fan that can eliminate moisture.

A ventilation standard is all about acknowledging the fact that dried air can be easier to heat and the property that is properly ventilated is less likely to develop damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable spaces. Connecting spaces such as the hallway aren’t liveable , and thus don’t require an opening door or window.

Each door, window or the skylight requirements for them to be in a position to open up to the outside while remaining closed, allowing ventilation and fresh air air flow.

The bathrooms in all kitchens as well as any other space in your home that has a bath, shower cooker or any other moisture-producing item will need proper extractor fan systems that are vented to the outside. This Healthy Homes Assessment service will make sure there is sufficient ventilation in every living space that includes extractor fans that are suitable in high moisture areas.

Insulation Berhampore

Ceiling and underfloor insulation is a requirement for all rent homes from 1 July 2019. All landlords and property managers have to make sure that the insulation is in line with current quality. In certain situations, the existing ceiling insulation or insulation in the subfloor space might need to be added or replaced.

A properly insulated home can help control condensation and lower the chance of dampness and mould, and also makes much easier to the household to hold heat.

Insulation requirements to meet the R-values of your area.

The "R" refers to thermal resistance and is a measure of how well insulation withstands heat flow. The greater the R-value, the higher the quality of insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – all of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 and underfloor R 1.3

Berhampore Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the inside It’s about having to ensure there is somewhere to allow surface, rain and ground water to go, and stop it from coming into the building. When it comes to moisture and damp it is often the things you don’t notice that can cause a lot of trouble and end up causing damage to your investment as well as harming your tenant’s health.

Properties that are rented must have efficient drainage to remove storm water, surface water, and ground water. This includes an appropriate runoff or outfall. Making sure that water has a location to go, and also that it doesn’t sit beneath structures is a crucial aspect of making sure your property is dry.

Alongside a drainage system to avoid moisture ingress, if your property has an enclosed space between your floor and the ground, a ground water barrier must be installed if it’s reasonably practicable to install it.

An underground moisture barrier generally a sheet of polythene that is placed over the ground, in order to block any moisture from the ground from accumulating into the structure. It also helps prevent from causing damage to the flooring insulation.
