Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Berhampore rental property, all Healthy Homes compliance items have to be finished within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Berhampore rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included within an updated, renewed, or amended tenancy agreement there may be additional penalties or an infringement fee.

If the the property manager doesn’t supply the necessary information within 21 days from being informed of the request, they will receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty of as much as $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be current before the tenancy agreement can be completed, and must be updated during the entire tenancy, as associated work has been completed.

It’s important to remember that landlords who have several rental properties can face greater penalties for non-compliance. The highest penalties are given only for serious violations. Those who have six or more properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Berhampore Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement in all Berhampore and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
