Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance items have to be taken care of inside of 90 days.

The person responsible to pay this fine is the one who is identified on the tenancy contract as the person letting the property out, so it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it should be kept updated throughout the tenancy as any related work is completed.

It’s also important to keep in mind that landlords who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for serious breaches. Landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

What time Do I need to be in compliance with the Healthy Homes Standards?

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Aro Valley and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.
