Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance items must be finished inside of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for the Aro Valley rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement for all Aro Valley and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with each Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

What are unreasonable gaps and holes?

If you are able to feel external air flowing in or the air is clear from a crack or a gap that is, it’s probably a gap or crack that requirements sealing in the way you can. Cracks and gaps that are large should be sealed permanently. Gaps greater than 3mm that let air in or out within your home need sealing. For example, if an open fireplace isn’t being used, it could cause draughts, and should be shut from. Landlords and property managers are responsible for ensuring that such draughts are squelched in the maximum extent possible.

There is no need to block off gaps or holes that are part of the building. For instance, small gaps around windows and doors could be required to allow for movement of the building as the household warms and cools so that they are able to be closed and opened rather than securing. Adequate heaters are important for well-being homes

Heating Aro Valley

Aro Valley rental properties need to have a stable heating source that is able to heat the living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs to be fixed (i.e., not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to check if the current fixed heater(s) are adequate or whether you will require to ‘top up’ with an additional heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered to be acceptable heating options in those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump, then it must be equipped with a thermostat. This will help make the heating more reliable and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like small apartments small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a central heating source, such as heat pumps, it might just require a top up in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Aro Valley

In some instances, an existing insulation on the ceiling or in the subfloor space may require to be filled with or replaced.
