Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on an Aro Valley rental property, all Healthy Homes compliance items must be finished within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to all of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager does not supply the information requested within 21 days of getting the notice, the tenant will receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for property owners or property managers who provide a false or false Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is named on the tenancy contract as the person letting the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it should be maintained during the entire tenancy, as associated work has been completed.

It is crucial to note that a landlord with multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for severe violations. Those who have six or more properties can be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Aro Valley and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
