Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Since the 1st July of 2021, when a new or renewed lease is entered into on the Aro Valley rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not supply the necessary information within 21 days from having received the inquiry, they will receive an infringement notice and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is identified on the tenancy agreement as the one who is renting the property and it could be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is crucial to note that landlords who have several rental properties can face even higher fines for non-compliance. The most severe penalties are handed down for severe breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement in all Aro Valley and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to any Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of lower temperatures in households. A damp home costs more to heat, resulting in wasted energy and resulting in higher bills.

What are unreasonable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming from a hole or gap, then it is probably a gap or an opening that requirements sealing in some way. Cracks and gaps that are large should be fixed permanently. Gaps greater than 3mm that allow air to enter or exit within the house need sealing. For example, if the open fireplace isn’t in use it could cause draughts, and should be shut off. Landlords and property managers are accountable for ensuring that such draughts are squelched whenever imaginable.

There is no need to cover up holes or gaps that are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement within the structure as the household warms and cools in order to let them be opened and closed rather than securing. Heating Aro Valley

Rental properties in Aro Valley must have a fixed source of heating that is able to heat the main or largest living space to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity to heat the living space in general. All landlords and property managers should ensure that the insulation is up to standards that are in line with the latest standard.
