Did you have any idea that the Healthy Homes Standards came into in force on July 1, 2021? Landlords must make sure that their Aro Valley rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rentals must be fully compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on an Aro Valley rental property, all Healthy Homes compliance items need to be completed within 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on the Aro Valley rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not provide the required information within 21 days from having received the inquiry, they will receive an infringement notification and could be fined up to $750.

In addition, there is an additional fine of as much as $900 for landlords or property managers providing a false or inaccurate Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the person who is named on the lease contract as the person who is letting the property, so it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement requirements to be accurate when the tenancy contract is signed, and ideally it must be updated through the tenancy period as related work is completed.

It is also important to remember that a landlord with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given for the most serious violations. Those who have six or more properties can be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement in all Aro Valley and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standard that apply or will be applicable to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Aro Valley

Draughts may lead to low temperatures inside homes. A cold house is more expensive to heat, resulting in wasted money and energy.

If a draught could be noticed from gaps that are not adequate or holes that it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming from a gap or hole, then it’s probably a gap or hole which needs sealing in any way. Large gaps and cracks should be sealed permanently. Cracks that are greater than 3mm and let air in or out of the house need sealing. For example, if an open fireplace isn’t in use it could cause draughts, and should be shut off. Property managers and landlords are responsible for ensuring that such draughts are squelched as far as imaginable.

There is no need to block up intentional gaps or holes in the construction. For instance, small gaps around windows and doors could be necessary to allow for movement within the structure when the household heats and cools, so that they are able to be shut and opened, rather than being stuck. Heating Aro Valley

Aro Valley rental properties require a reliable source of heating which can warm the largest or main living space to at least 18degC even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements for it to be permanent (i.e., not portable) with at minimum 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to determine whether the existing fix heater(s) are sufficient or whether you will require to "top-up" with an additional heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump it should include the thermostat. This will help make your heating more consistent and effective. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a fixed heating source such as the heat pump, it may require an upgrade to be able to meet the standards. Some types of heaters can’t be used to comply with the quality since they’re either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Aro Valley

Each living space within a rental house must have at least one openable window or exterior door to offer natural ventilation. In addition, humid areas such as kitchens or bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

This ventilation standard is all about acknowledging the fact that dry air will be much easier to heat, and that a well ventilated rental property is less likely to be a victim of damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are all considered living spaces. Connecting spaces like the hallway are not considered liveable and don’t require an opening door or window.

Each window, door or skylight needs at least of opening to the outside and remain set in an opening position in order to allow the circulation of fresh air and air flow.

The bathrooms in all kitchens and every other room of your home that has a bath, shower cooker or any other moisture-producing item will need adequate extractor fans which are vented to the outdoors. Insulation Aro Valley

Insulation for underfloor and ceilings has been compulsory on all rental homes since 1 July 2019. Property managers and landlords must make sure that the insulation is up to this new standard. In some instances, an existing insulation on the ceiling or in the subfloor space may require to be topped up or replaced.

A properly insulated home can reduce condensation and lessen the likelihood of mould and dampness and also makes more easy for the home to keep heat.

Making sure your rental property is protected from the effects of moisture isn’t just a matter of what’s inside the building; you have to make sure there is somewhere for surface, rain and underground water to flow, and prevent it from getting into the building. When it is about damp and water, it is typically not apparent that it can become a big problem that can cause the property to suffer and affecting your tenant’s health.

Properties that are rented must be equipped with effective drainage to remove storm water, surface water and groundwater, with the proper outfall or runoff.
